Last time, we looked at how legal positivism in its reformist zeal declared that the only source of the law is the state, and how this ended up centralizing power like never before with an ongoing tendency to authoritarianism. The Legal Realists saw the real power, not in the legislature, but in the judges who interpreted the law. One of the first and greatest of the legal realists was OIiver Wendell Holmes, Jr. He was an associate US Supreme Court justice until he was 90 years old. Holmes did not believe the law was rational or logical. He rejected natural law theory as fairy tales. To him, law existed only in action, in the courts, and had to be studied as to how it actually worked without sentimentality. Legal Realism arises out of American pragmatism after WWI, a cold soulless philosophy Williams James called the "Bitch Goddess of Success". What Holmes should have had the wisdom to foresee was that by kicking open the door to law as a technical skill only, detached from morality, he set the stage for Critical Legal Studies, closely tied to Critical Race theory, and to progressive activist courts which see law as merely about power and politics. Legal Realism can be seen everywhere today, in Trump being struck from the ballot in Colorado, to the conviction of the innocent for the crime of having the wrong skin colour or political point of view or not wanting to fly a rainbow flag. Holmes was also famous for his views on Eugenics, reflected in the case law, a pragmatism we see today in places like Canada where 50,000 have been Euthanized since 2000. We are a long way from Natural law and the pursuit of the good, the true, and the just.

In this video, I tear apart Bill C-63, the so-called Canadian Online Harms Act, which is little more than a thinly veiled piece of tyranny designed to suppress political opposition, political debate and the spread of ideas the Trudeau government doesn't like. I look at the Orwellian legislation that if passed could put you in jail for a pre-crime, something you might do in the future, if someone who doesn't like you files a complaint. The penalty for words the government doesn't like can now be life in prison. I then look at the proud tradition of public attacks on tyranny in the form of a vicious speech called a Philippic, named after Demosthenes attack on Phillip II of Macedon and picked up by the Roman jurist Cicero in his attacks on Mark Anthony. The tradition of democratic and republican government in the West hinges on the ability to attack tyranny, or engage in any serious debate, without fear of offending. Hate crimes are tools of tyrants. The notion that hate is a social evil is folly, and will kill civic life in the West.

In this video, I breakdown of the Canadian Federal Court Decision declaring Trudeau's use of the Emergency Act illegal and what they aren't telling you! Although the Federal Court declared the proclamation, regulation and order ultra vires, and parts of the regulation contrary to the Charter of Freedoms, the TRUTH IS THE DECISION is a road map to greater state power and a how-to manual to crush future protests. I demonstrate evidence in the regulation itself of bad faith on the part of the government and that the suspension of civil liberties wasn't about the clearing supply chains, diesel fumes or the presence of trucks in Ottawa... the Act was used to crush political dissent... and it will happen again!

For those who didn’t know, Blade Runner 2049 is a sequel to the 1982 science fiction film directed by Ridley Scott set in a dystopian future Los Angeles of 2019, in which synthetic humans known as replicants are bio-engineered by the powerful Tyrell Corporation to work on space colonies. When a fugitive group of advanced replicants led by Roy Batty escapes back to Earth, burnt-out cop Rick Deckard reluctantly agrees to hunt them down. The sequel tells us much more about the world of 2017 (when it was made) or 2023 than about the future. The movie 2049 really has nothing to say about anything, but its surfaces tell us everything about ourselves, our civilization, our declining virtues and esthetics and a theatre on its lasts legs. This film review is therefore entirely "superficial", but in looking at the messaging, we are seeing the only thing of lasting value in this film.

In this video I examine the dominant theory of law in our time, the idea that law is what the state says it is. We call this legal positivism and it emerged with the Renaissance and Enlightenment as thinkers sought out a world governed by science and reason, one where man would be in charge. Jeremy Bentham, the famous utilitarian philosopher, sought to reform the legal system by drawing clear lines between law and morality. Laws would be limited to the commands of the sovereign. In this way, by setting out clearly what the law is, he expected legal reform would be made easy. Bad laws could be changed and judges would obliged to enforce the new reformed legal system. What Enlightenment thinkers failed to understand was power. By making the state the sole source of law, the effect was to centralize power and increase vastly the power of the modern state. Bentham's best laid plans went awry and the way was paved for the modern total state. No longer were there any natural limits on what the state could do. Words were not only all powerful. Words can now change reality itself. Parliament can now indeed declare a man a woman and a woman a man.

Cancel Culture is a phrase that hides the violence behind the progressive agenda. The roots of Cancel Culture are to be found in the ancient concept of Civil Death. We are really two people: a physical person and a legal person. It is our legal personality that allows us to open a bank account, get married, make a will and vote. In ancient Rome, a traitor could be deprived of his status as citizen, and deprived of fire and water. In England, a traitor would be tainted with blood pollution, depriving him of the right to pass on his property. When Nigel Farage and the Canadian truckers were deprived of the right to open a bank account, or had their assets frozen, this was an application of the concept of Civil Death, effectively a sentence of death on their legal persons. This video examines how the concept of Civil Death has exploded in the modern total state, even as the courts insist the concept is dead and buried.

Waters three part series on Natural Law documents the entrenchment in the Irish Constitution of so-called "Fundamental Rights" only to see them systematically ignored, reinterpreted and in some cases outright abolished. How did that happen? Waters doesn't answer the question. The problem may be three fold: "fundamental rights" as defined in the Enlightenment are not really natural law rights, but gross overgeneralizations rife for abuse (2) when inalienable rights are put in a written constitution, whatever their source, a modernist legal system treats them as "human law" subject to amendment and abolition, like any other human law and (3) pluralism seems inconsistent with a natural law legal system, favouring power systems like positive law, namely, that the law is what the state says it is.

The origins of Natural Law are obscure. The earliest societies had no conception of a Divine Rule Maker. The Gods and Spirits were capricious; omit your rituals or fail to supply the Gods with their quota of still beating hearts, and the sun may not rise in the morning. From the pre-Socratics, to Plato and Aristotle to the Stoics, Natural law takes on the features that still influence legal philosophy and politics to this day: rationalism, universalism, the ethical and moral necessity of law and the ability for all to access the logos of the universe through observation, experience and contemplation. In this first introductory look at Natural law, we cover the period up to the Stoics, and their most notable practitioner, Marcus Aurelius, and consider what their ancient wisdom might tell us about our modern world.

Reviewing "Aesthetics of Law and Literature: An Anatomy of the Legal Imagination" by JA Julia Shaw. The author examines how lawyers and judges and by implication the state use language, literary and rhetorical devices in so called "dry" legal language, as a powerful tool of control. Under the veil of Reason and Objectivity, the language of a law is in fact rich with aesthetic content and manipulation. Legal language can make the unreal the real, the immoral moral, and vice versa and make even the most draconian law seem caring and compassionate. With this in mind, we will look at how the language of "Medical Assistance in Dying" (MAID) legislation in Canada can tell a completely different story by tweaking the language a "little".

From dawn of civilization, Man has understood the iron ties between Law and Force. Critical to understand force is to know who has legitimate Authority to rule and use the Coercion of the state to enforce that Authority. In this episode we look at Coercion or Violence as a means of enforcing legitimate and illegitimate authority and distinguish the two. Is law and Justice about who is more powerful? Is the hangman the cornerstone of society. Or is force extraneous to law, which is really only about consent through a social contract or mass democracy? Is the answer that law is a much more complex and flexible idea, rooted in ourselves and our society? We show how international and globalist law is increasingly enforceable through illegal means, resting its authority on "legitimacy" or rather higher moral authority of their own creation to create a new society -- and how the technocratic therapeutic state is, increasingly, able to mask coercion under a veil of consent through advances in behavioural sciences and the pathologization of dissent.... to disagree is an illness that needs treatment. We also look at how the total state is using increasingly clever means to neutralize rights, such as property rights (gun seizures), without having to resort to expensive policing and technocracies use chaos and anarchy as a political tool.

From dawn of civilization, Man has understood the iron ties between Law and Force. Critical to understand force is to know who has legitimate Authority to rule and use the Coercion of the state to enforce that Authority. In this episode we look at Coercion or Violence as a means of enforcing legitimate and illegitimate authority and distinguish the two. Is law and Justice about who is more powerful? Is the hangman the cornerstone of society. Or is force extraneous to law, which is really only about consent through a social contract or mass democracy. We show how international and globalist law is increasingly enforceable through illegal means, resting its authority on "legitimacy" or rather higher moral authority, and how the technocratic therapeutic state is, increasingly able to mask coercion under a veil of consent through advances in behaviou
ral sciences and the pathologization of dissent.... to disagree is an illness that needs treatment. We also look at how the total state is using increasingly clever means to neutralize rights, such as property rights (gun seizures), without having to resort to expensive policing and technocracies use chaos and anarchy as a political tool.

What can we learn from the body language of our leaders at press conferences around the West? What are they trying to tell us? From dawn of civilization, Man has understood the iron ties between Law and Force. Critical to understand force is to know who has legitimate Authority to rule and use the Coercion of the state to enforce that Authority. In this episode we look at Authority through the genius of Max Weber, who identified three pure types of legitimate authority: 1. Bureaucratic; 2. Traditional; and 4. Charismatic. Weber also predicted the relentless machine of modernization within capitalism and its endless drive to rationalize and systematize all aspects of the human society, down to identity itself, pushing religion, mysticism and even magic aside. The result he also predicted was disenchantment and despair. The answer may be the rise of charismatic personalities who can save society from a soulless machine and man from this pit of monotony and enslavement. But the machine may have a trick up its sleave. Rather than wait to be replaced by the GREAT MAN, the regime seems to have evolved a third form of authority, the 4. Impersonal Charismatic. Driven by the irrational, by power over profit, institutions of the state and their private agents, the corporations, both using vehicles like Woke capitalism hypnotize the population into belief that the institutions and corporations are the source of magic, with extraordinary capacity for holiness and goodness, and wildly charismatic, putting out fake charismatic leaders, who are merely agents of the regime while snuffing out the rise of any true exceptional personal talents in the population. When it feels safe, if we allow that to happy, the bureaucracy will return to routine and impersonal rule.

Perhaps never in human history has the relationship between law and morality been more important. And yet the relationship is far from simple. There is no question that one of the sources of law’s legitimacy and authority is the belief in our moral obligation to obey the law. Our ancestors saw law as having divine origins. That made obedience easier, since if the state didn't get you, the gods would -- as Orestes can tell you. Some laws could be traced directly to God, like the 10 Commandments. Other laws were treated as divinely inspired. Lawgivers in anciety times were often treated as semi mythical or semi divine or heroic figures. In the video, we look at how law and morality were understood by our ancestors, how the ancient Greeks introduced the notion of a rational order to the universe, governed by intelligible laws ascertainable by rational investigation and, in the process, succeeded in partialy decoupling human law from divine law. The video addressed the moral obligation to obey even human law, illustrated by trial of Socrates culminating in the Wolfenden Report in 1957 that recommend that the laws get out of the bedrooms of the nation entirely. We look at the famous Hart-Devlin debate on morality, the law and freedom, and whether certain same sex sexual practices should be decriminalized. Finally, we look at how Lord Devlin's argument that the state must continue set moral standards, continue to enforce private morality, even where there is no harm to others, for the good of society as a whole and to protect the vulnerable, and how the failure to heed his warning is playing out today.

Mozart is arguably, and in my opinion certainly, the greatest composer Western civilization ever produced. He is so important, people who have no clue who he is, and never consciously listened to his music… and who probably say they hate classical music… would still recognize many Mozart tunes… But more importantly …. our very idea of a melodic line, our ear for chromatism and our familiarity with certain harmonic progressions, or the blending of harmony and counterpoint, even our understanging of the emotional or dramatic meaning of sound ... is rooted in Mozart. Many of his pieces are well known, but others aren't fully appreciated. I include moments here, not just tunes, to capture both drama and pure energy. There can be no real top 10 of under appreciated pieces or moments. ... it should probably be a list of a 1000. But here is my top 10 Mozart moments you’ve probably never heard of never noticed.

L'Allegro and Il Penseroso are among Milton’s finest early poems. Companion poems were popular in the late 16th and early 17th century. I have already read L’Allegro and you can check that out and earlier videos. In this video I will read the companion, Il Penseroso. L’Allegro (which means "the happy man" in Italian) has from its first appearance been paired with the contrasting pastoral poem, Il Penseroso ("the melancholy man"), which depicts a similar day spent in contemplation and thought. Il Penseroso” simply cannot be read without “L’Allegro.” Just as in life, we cannot just choose pure action or pure contemplation. Do we join the revolution, the ruling government, and just lay back and think about events as they unfold?
Milton in life was Cromwell’s latin secretary and almost lost his head after the restauration. Likewise, we all have choice to act, join in whirlwind and counter forces that move the modern world or we can be cautious and await events…. Events may then pass us by or sweep us aside like a tornado….
Or perhaps you will be lucky like Cincinatus, and save Rome… and then retire to your farm and the pastoral life. Few of us will be so lucky.
