Just a quick update before I start, the PM has invited all opposition party leaders to a one hour meeting in Number Ten at 6 pm tonight.

She is then said to be preparing to make a statement to the nation.

A lot is being read into this, but I think it'll be the usual guff to try and garner national sympathy and support.

Now to business.

Shortly before appearing in the Commons for PMQs, the PM despatched a letter to the EU Council president asking for a short, one-off extension to Article 50 to last until the 30th of June.

But as I have pointed out many times before, the EU commission is adamant that, if the UK is still within the Article 50 process and therefore still an EU member at the start of the EU parliament elections on the 23rd of May, then the UK must participate in those elections.

And the EU Commission President, Jean-Claude Juncker, has already made that clear in an earlier, public letter.

Referring to a telephone call today between Juncker and May, a spokesman for the Commission President said:

"European elections have to be held if the extension date is beyond May 23. This is the position of the commission and this is what the president informed the prime minister again."

And the latest reports indicate that the PM will either get a short extension up to the elections, or a much longer extension on the promise that the..

All I can surmise from this current Brexit debacle is that Theresa May is in a panic to get her deal and her deal alone into place - at all costs and any cost.

And that is exactly why she is so desperate to get an Article 50 extension.

It is now legislatively impossible to get the requisite Act of Parliament in place before the 11 pm 29th of March deadline that would allow her to ratify her deal. In fact if truth be told, that boat probably sailed last November.

Reports suggest that, yesterday, Theresa May was initially after a nine month Brexit extension.

This would have given her the time to try and realistically battle the absolutely critical to her plans EU Withdrawal Agreement Bill through to Royal Assent. She could then have gone to Brussels and ratified her Withdrawal Agreement treaty.

The realistic minimum amount of time she would need for her Withdrawal Agreement plans would be a six month extension, but even that would be pushing it.

But, after pressure from the Brexiteers in her party who are warning her of the repercussions on the party, if she goes for any extension, let alone one that forces EU MEP elections on the electorate, she has it seems caved in and is asking for an extension of three months to the end of June this year.

But all a three month extension will do is delay the decision to go WTO for those three months.

Because, even if Theresa May got her deal through the House of Commons and got her three months extra, she still has to get this new bill through parliament and on to the law books, before she can actually ratify ..

There you have it! The Prime Minister of the UK, Theresa May, is now attempting to remove the no deal Brexit option from the table.

Theresa May has now shown her true colours. And they are blue with gold stars.

The BBC is reporting that she is writing to the EU to ask for an extension to the Article 50 process until the end of June.

This comes after a cabinet meeting this morning where there was, according to the BBC political editor Laura Kuenssberg, no agreement around the table on how long that extension should be for, nor on what reason that could be given for asking for one.

The BBC also reports that one source "expressed frustration that the prime minister did not make a clear indication of the option she would actually argue for".

And Kuenssberg Tweeted out that the Leader of the House of Commons tore into her colleagues calling them a Remain cabinet while arguing for leaving without a deal at the end of June.

It doesn't matter what May does now, her deal is toast and the EU will not be offering her any more assurances. They will stand firm in the face of her weakness.

In fact I wouldn't be surprised if they only gave her one option - that they would extend Article 50 for one purpose only and that is to give her time to legislate for reversing Brexit entirely, if that's what MPs voted to do within the next week.

And if I were Juncker, Tusk and Verhofstadt I would now be rubbing my hands with glee as I added in the caveats that there must also be firm assurances on timescales for joining the Sch..

So, now that the Speaker, John Bercow, has made it impossible for Theresa May to represent her shoddy Withdrawal Agreement to the House of Commons again during the current parliamentary session, what on earth will she do?

The first thing to note is that HMS UK has set sail for a WTO Brexit at 11 pm on the 29th of March and Mr Bercow has, by his intervention, locked the tiller in place for the moment.

The reality is that the only way to unlock that tiller now is to get an Article 50 extension from the EU27.

So that is probably what Theresa May will focus on right now.

She needs that extension so as to pass the legislation that would make her deal lawful and enable her to ratify her non-Brexit Withdrawal Agreement surrender treaty.

But even with a three month extension, which is the maximum she might get away with without needing to hold EU MEP elections, those three months could well prove insufficient.

As I've pointed out before, the key piece of legislation that has to go through the full parliamentary procedure and be signed into law by the Queen, is the EU Withdrawal Agreement Bill, or WAB, which hasn't even been published yet.

And that was meant to be given six months to make its way through some very tough debates and votes.

So there is no assurance that this bill would get through in a short extension anyway - so why would the EU agree to that?

Anyway, Mrs May will go to the EU Council meeting on this Thursday the 21st of March, to try and make her case, whatever it is and also try and get something out of the other leaders that she can p..

Theresa May must have had what one can only call an 'emotional moment' when the Speaker of the House of Commons stood up at three thirty and made the statement that unless the PM brought back a motion that was different, or substantially different, from the last ones then he would not allow it to be put before the House again in this parliamentary session.

That will of course, without further changes obtained from the EU, kill off her Withdrawal Agreement surrender document as it stands - stone dead!

And the obvious sign that the government was bounced by this move of the Speaker's is shown by the fact that the Leader of the House had just entered the Chamber, presumably to brief the House on upcoming business, but soon scuttled off again.

Oh, to have seen the looks on the faces of not only Theresa May, but also those of Juncker, Tusk and Verhofstadt as Bercow made his pronouncements.

MPs then quizzed the Speaker for over an hour, with those from both sides of the Brexit debate trying to lever some sort of hint from him as to any leverage contained in the rules that they may have available to them in the coming 11 days left before the UK sails out of the EU on WTO terms.

And the answer seems to be that they should avail themselves of the Emergency Debates procedure at their disposal as provided for within the House of Commons Standing Orders Article 24.

And when I say, 'those that wish to derail Brexit' I also include Theresa May and her cronies who are still pushing that rotten Merkel authored Withdrawal Agreement surrender document.

But, even with all the froth of the Machiavellian tricks, the House of Commons motions, the meetings in Downing Street with promises made behind closed doors across Whitehall - Statute Law stands firm and the default legal position remains that the UK leaves the EU on WTO terms at 11 pm on the 29th March 2019.

The only things that can stop that, are if our government takes the politically stupid step of revoking Article 50, or making a legal agreement with the EU to extend the Article 50 process. And there are legal arguments on both sides about how this can be done and for how long it could last.

But that aside, if you've been listening to and watching Theresa May you can see that she is now totally committed to the Withdrawal Agreement.

She will continue to push, twist arms, cajole, threaten, promise, open the public purse and use any trick she can to gain the support she needs for her deal.

But each day delayed means a proper full UK exit from the EU is another day closer.

But worryingly, some MPs are now saying they will back her deal if she promises to resign afterwards.

Would you trust her? I wouldn't! Especially as to get her deal through some..

It appears that, while Theresa May pleads with MPs to back her deal, the EU is preparing for a new UK Prime Minister and will not allow whoever it is to unpick their Withdrawal Agreement plans for the UK.

The PM has asked that MPs vote like 'democrats and patriots' and go for an 'honourable compromise' and sign up to her deal when she puts it before them for the third time this coming week.

And in an Article for the Sunday Telegraph, while touting the supposed 'legally binding improvements' she's made to her deal, yes she called them that in print, she says that if MPs don't back her deal then "we will not leave the EU for many months, if ever".

To get her deal done and dusted though, she does need an Article 50 extension.

And on this she said that delaying Brexit would not be an ideal outcome but the British people would accept it, if it led to a swift Brexit.

Well, message to Theresa, if it involves your deal, it will be neither swift nor Brexit, so I will not be accepting it!

Now the BBC is saying that if her deal is not accepted before the EU Council meeting this Thursday the 21st March then Eurocrats are contemplating a much longer delay to Article 50.

And the Guardian reports that the EU has lost all faith in Theresa May to deliver her, or more probably their, deal and are therefore war-gaming what would happen if Theresa May was ejected from office and a new PM installed.

It quotes one diplomat as saying:

"The clear feeling is that there is a complete lack of confidence in the British prime minister to deliver on this deal."

And a diplo..

Well, there's a phrase that won't come as any surprise to anyone who's been paying attention - UK MPs are totally intent on trashing the will of the people and reversing Brexit.

The Labour party shadow chancellor, John McDonnell, said today that MPs will move heaven and earth to prevent the UK leaving the European Union without a deal.

He also confirmed that the Labour leadership would be backing an amendment by two of his party's MPs, Peter Kyle and Phil Wilson, that could allow Theresa May's deal or any deal for that matter, to go through as long as there was a referendum at the end of it.

And the Liberal Democrat soon-not-to-be leader, Vince Cable, said that if Theresa May's deal was rejected yet again this week, then parliament could end up cancelling Brexit.

Speaking to the Press and Journal, he said that if faced with a clear choice of a WTO Brexit of no Brexit at all, then MPs would vote for no Brexit at all and face a backlash.

But going back to the people, he said, and humbly asking them to sort it out would be reasonable.

Anyway, it doesn't matter which route the Remainer establishment wants to take in its efforts to reverse Brexit, they all rely on an extension of Article 50 in order to give them time to put major legislation in place to achieve it. Whether it be via Theresa May's Withdrawal Agreement, holding a second EU referendum or fully revoking the Article 50 letter.

At present the assumption seems to be that the PM can just get on a plane to Brussels, chin-wag for a while then bring b..

Namely, get it past the House of Commons, which she hasn't yet done.

Get it past the House of Lords, which has been achieved.

And finally get a completely new bill onto the law books, namely the EU Withdrawal Agreement Bill.

Please do not get this confused with the Withdrawal Act, which is already on the statute books.

This has not been published yet so the public won't know what's actually in it, but it's what is most likely to be in it that will surprise people.

According to the Institute for Government, once this Act becomes law it will, amongst other things:

1. Keep parts of the European Communities Act in force for the duration of the transition period. This will allow the UK to update its statute book to reflect new EU laws that come into force in the transition, and will preserve the jurisdiction of the European Court of Justice.

2. Give the Withdrawal Agreement, and any EU law incorporated into the Withdrawal Agreement, a form of “supremacy” over UK law.

3. Set out a domestic process for the commencement of the Irish border backstop.

Now, we are told that the EU Withdrawal Act passed into law last year, will repeal the European Communities Act 1972 (or ECA) to take us out of the EU so we can take control of our borders, laws and money.

But what the Institute for Government is saying, is that some of the law contained in the ECA 1972 will have to be put back into force by this new bill when it becomes law.

There are reports that several Tory MPs and would you believe it the DUP, are now beginning to crack under the strain and are looking at the Theresa May deal again to see if there's anything in it that they could hold up and say 'this is why I'm now voting for it'.

For example, the Tory Brexiteer MP Esther McVey, has already hinted strongly on the Nick Robinson podcast 'Political Thinking', that she may now back the deal when it is resurrected from the catacombs next week.

And with the DUP currently in what is being described as "ongoing and significant discussions" with the PM over their future supply and confidence deal with the Tories, there is much speculation that they are also about to buckle.

Especially as the Chancellor is also involved in the discussions, raising the speculation that the DUP politicians are being offered some more dosh for Northern Ireland.

Another factor is that the Attorney General, Geoffrey Cox QC, is also there, along with Michael Gove.

Earlier this afternoon, the DUP deputy leader, Nigel Dodds, did come out of the discussions to update the press saying that this was about having the party's fears over the backstop 'assuaged' and that nothing should be read into the presence of the Chancellor.

Now the Mail reports that the Attorney General is under pressure to somehow adjust his advice to ease the fears that the UK will be stuck per..

At the moment the press are all saying that we are now highly unlikely to leave the EU on the 29th March 2019.

This is presumably based on the motion passed in the House of Commons last night where the government says it will ask for an extension.

But, unless it is to get her Withdrawal Agreement legislation through, or is for another definite and clearly defined purpose, then it is highly unlikely to be agreed to by the EU.

And as I've said many times before, this changes nothing in the law as it stands.

The legal default position enshrined in statute is that the UK will leave the EU at 11 pm on the 29th March 2019 on WTO terms. And there are only two weeks left to interfere with that process.

Now, some will point out that a Minister of the Crown has the power to change that exit date within the EU Withdrawal Act 2018, but I would point out that they would have to have a legal reason to do so in both UK and EU law prior to amending that date.

Be in no doubt that Theresa May cannot get her Withdrawal Agreement in place without an Article 50 extension.

And here's why:

Under the Withdrawal Act 2018 before she can ratify her deal with the EU, she has to have her deal agreed in the Commons, which it has not been.

Now, I had thought that it needed to go to the House of Lords next. But it turns out that they say they complied with that part of the legal requirement on the 14th January this year, by voting that the House of Lords 'takes note' of it after they debated it.

But the next step is a real biggy and requires the PM to steer a brand new bill ..

The government side will be pleased with itself that it has managed to get its motion through unscathed tonight.

Theresa May and her whips have managed to steer the government motion through the house, to only extend Article 50 if her deal gets accepted by the Commons.

Although there were a couple of close shaves. Especially the near call when the amendment calling for Parliament to wrest control of the process from the government was defeated by a squeaky two votes!

But significantly, the amendment calling for a second referendum was defeated, with Jacob Rees-Mogg claiming it is now therefore off the table. And why? Because it was a huge loss by the Independent Group led second EU referendumers of 85 votes for and 334 votes against!

And to be clear, as nothing has yet changed in statute law, then the default position is still that the UK leaves the EU on WTO terms at 11pm on the 29th March.

And this position will persist until, as I understand it, either a short extension to Article 50 is sought by the government using the Royal Prerogative - and agreed by the EU27, or statute law is passed and enacted that makes a long Article 50 extension including EU MEP elections possible, which would also need the permission of every EU27 nation state.

Now, under today's government amendment, which by the way won by a margin of 412 votes to 202, - a majority of 220, the PM will now get until the 20th March, which is next Wednesday, to try and get her deal through the House of Commons and if she is able to do that ..

As the votes came in last night those Remainer MPs were all cheering thinking they'd saved themselves from having their EU safety blanket ripped from their grasp.

However, they didn't look so happy when Theresa May said she was soldiering on with her Withdrawal Agreement plan and Jacob Rees-Mogg had the Speaker confirm that nothing had actually changed and that leaving on the 29th of March under WTO terms was still the default legal position.

Now to this afternoon's entertainment.

The government has now tabled its motion to be debated and amended later today and voted on after 5pm.

The government motion reads:

That this House:

(1) notes the resolutions of the House of 12 and 13 March, and accordingly agrees that the Government will seek to agree with the European Union (EU) an extension of the period specified in Article 50(3);

(2) agrees that, if the House has passed a resolution approving the negotiated withdrawal agreement and the framework for the future relationship for the purposes of section 13(1) (b) of the European Union (Withdrawal) Act 2018 by 20 March 2019, then the Government will seek to agree with the European Union a one-off extension of the period specified in Article 50(3) for a period ending on 30 June 2019 for the purpose of passing the necessary EU exit legislation; and

(3) notes that, if the House has not passed a resolution approving the negotiated withdrawal agreement and the framework for the future relationship for the purposes of section 13(1)(b) of the European Union (Withdrawal) Act 2018 by 20 March 2019, then it is ..

As the dust settles after another crushing defeat for the Merkel authored Withdrawal Agreement that Theresa May still refuses to ditch, we should now look at what is likely to happen in the House of Commons today.

There is much talk that Brexit will now be stopped by MPs simply voting a no deal down today and voting for an extension to the Article 50 process tomorrow.

But those votes stop nothing, without further very substantial legislative action being taken.

But first, what are MPs going to actually be voting on this evening, as that is the important bit right now.

The motion put forward by the government says:

"That this House declines to approve leaving the European Union without a Withdrawal Agreement and a Framework for the Future Relationship on 29 March 2019; and notes that leaving without a deal remains the default in UK and EU law unless this House and the EU ratify an agreement."

So, although the government is asking parliament to vote against a no deal today, it has not been removed from the table.

What Mrs May is saying it's either her deal or no deal.

The reference to 'ratify an agreement' means vote for her deal because hers is the only deal that can be ratified.

Now some amendments to this have been put forward.

Dame Caroline Spelman, backed by the likes of Yvette Cooper and Nick Boles, is a simple change to the whole thing into:

"That this House rejects the United Kingdom leaving the European Union without a Withdrawal Agreement and a Framework for the Future Relationship."

By voting for that MPs would be sayi..

With Labour, the DUP and the ERG set to vote against the Withdrawal Agreement, it looks to be going down to another hefty defeat.

Last night the EU Commission President Jean-Claude Juncker and our Prime Minister came to an agreement to add this legal instrument in to the Withdrawal Agreement mix in order to attempt to solve the Irish border backstop issue.

The Attorney General, Geoffrey Cox QC, was asked to give his verdict on it and duly did so, by saying that nothing had really changed, which put the cat amongst Theresa May's pigeons.

Right now the house is engaged in heavy debate over it with another substantial defeat for Mrs May looking to be on the cards, as both the DUP and the Tory Party European Research Group have said they will vote against it.

Tory Brexiteer MP and ERG member Bill Cash, who was one of the lawyers asked to look at the additional documents said:

"In the light of our own legal analysis and others we do not recommend accepting the Government's motion today."

Now, I'm in a council meeting tonight so I won't know the results until after I come out, but I expect to see May's deal crushed.

One other point to note here is that the Remainers did put down a pile of amendments to this motion calling for the extension and/or revocation of Article 50. But the Speaker John Bercow, did not select any of them for debate or voting on tonight.

However, the related documents that our MPs are debating on and will be voting either for or against tonight, have actually yet to be endorsed by the..

The Attorney General's legal advice on the Irish border backstop instrument that the Prime Minister managed to negotiate with the EU, has now been published and it basically says there's no change of any significance.

Geoffrey Cox QC, says in his legal advice:

"...the legal risk remains unchanged that if through no such demonstrable failure of either party, but simply because of intractable differences, that situation does arise, the United Kingdom would have, at least while the fundamental circumstances remained the same, no internationally lawful means of exiting the Protocol’s arrangements, save by agreement."

So we could well still be stuck in the backstop for ever with no way out.

That should finish her deal off today.

There is no need to wait around for the Star Chamber of eight lawyers put together by the Tory Party European Research Group to make their pronouncements on it.

The Shadow Brexit Secretary, Keir Starmer responded to the news by saying:

“The Attorney General has confirmed that there have been no significant changes to the Withdrawal Agreement despite the legal documents that were agreed last night.

“The Government’s strategy is now in tatters.”

The rest of us would say it's been in tatters for some months now and all because the government and most MPs in parliament point blank refuse to do what the electorate instructed them to do.

I gather the Attorney general will be making a statement to the house at 12:30 this afternoon.

The title of the document in question is long, but it calls itself an 'instrument relating' to the Withdrawal Agreement.

But the first thing I noted in the press conference video was the stony faced Mrs May. She did not look like a national leader that had reached a significant breakthrough, no smiles and chit-chat, she was not a happy bunny at all.

Now, although I am not a qualified lawyer, one of the things that concerns me is the reference in the document to Article 31 of the Vienna Convention on Treaties.

What it says is that this instrument therefore "...constitutes a document of reference that will have to be made use of if any issue arises in the implementation of the Withdrawal Agreement. To this effect, it has legal force and a binding character."

First question, how much real "legal force" does it have and what is the difference between legally binding and a "binding character"?

The second question I have, is how much weight does this have when, as I understand it, the EU itself is not a signatory to that convention?

The third question I have is, does this mean that the Withdrawal Agreement is actually a Treaty between 28 separate states, or is it an agreement between the UK as a nation state and the EU as an international organisation?

We are all now waiting to see what business the government has put on tomorrow's House of Commons order paper.

Will it be a 'meaningful vote'? Will there still be the promised votes on stopping a no deal Brexit and extending Article 50?

Anyway, as we reach this critical phase in our exit from the EU I thought it a fitting moment to warn people about what will follow, whatever happens.

But I'll start first by going back to the day after the EU Referendum.

I remember the feeling of Euphoria while quaffing Champagne and breakfast with fellow Brexiteers on the morning of the 24th June 2016, having stayed up all night and insisting on watching until the very last result was in, counted and announced.

But it was soon very apparent that it was not going to be easy. We had in reality only got to the starting gate. Now we were racing for our survival as a nation against the whole UK Remain establishment and press.

The Remainers got to work in trying to reverse Brexit.

And that race is still being run right now!

The run up to the referendum and the vote itself was merely the first round of the competition.

The current struggle to achieve a full and proper exit from the EU is merely the second round of this contest.

Now for the stinger, whatever happens next is the third round!

We have to fully realise that in any realistic scenario you can think of, the one thing that will remain constant over the n..

So I was honoured and privileged to be asked, as the Deputy Mayor of Shaftesbury, to read out the Commonwealth Affirmation from the Town Hall balcony at 10 am as the the Commonwealth Flag was unfurled.

I'll now read out the Commonwealth Affirmation:

"Joining together as members of one worldwide Commonwealth community, and valuing the personal dignity and worth of every citizen, we raise this flag as a symbol of the ties of kinship and affinity that we cherish.

"We draw inspiration from our diversity, and the opportunities for working together, as a rich source of wisdom and a powerful influence for good in the world.

"We affirm our commitment to upholding the values set out in the Commonwealth Charter, to serving one another in a spirit of respect and understanding, and to advancing development, democracy and cooperation locally, nationally and internationally."

This day, I believe, will become more important to us as time progresses post-Brexit!

Now, as expected the Prime Minister, Theresa May, has failed to break the deadlock in the talks over her rotten deal.

The Eurocrats are even more desperate to lock the UK inside its straight-jacket than our PM is, if you could believe such a thing.

Over the week-end the PM had been putting g the feelers out to see if she could get a bit more time to try and get a breakthrough on the Irish Backstop issue and now there is talk that she may even pull her promised so-called meaningful vote tomorrow in the face of another certain and crus..

There you have it, even the voters in Theresa May's own constituency want to see her deal ditched!

A YouGov poll of 25,000 voters conducted on a constituency by constituency basis shows that the majority of voters in all 632 parliamentary constituencies in England, Scotland and Wales want their MP to vote Mrs May's Withdrawal Agreement down.

And in Theresa May's own constituency of Maidenhead, those asked rejected her deal by a majority of 54% to 46%.

And while out Canvassing, Andrea Thorpe, the Chairman of Maidstone & Weald Conservative Association found scant support for the Withdrawal Agreement. In fact, leaving on a no deal Brexit basis seemed to be the favourite route to take.

And a poll run by BMG Research for the Independent also shows that 52% of voters would not like to see any delay to Brexit of more than six months.

Doesn't this just go to show how many of our MPs are so up their own existences that they have absolutely no clue what their constituents really think?

But Jeremy Hunt is still there, saying that Brexit will be lost if his fellow MPs don't vote for Theresa May's deal.

Talking on the BBC Marr Show, Mr Hunt said that the Tory party was in perilous waters - now there's an understatement, if they don't just get on and deliver a WTO Brexit by the 29th March, their party will be finished!

He also said that there was 'wind in the sails' of those opposing Brexit and all they needed to do to stop Brexit, he said, was vote her deal down, get an extension and then get a second referendum.

And by the time MPs get to vote on Theresa May's, Merkel authored, non-Brexit Withdrawal Agreement on Tuesday the 12th of March, there will only be 17 days left to go.

And of course we then have the two votes on the 13th and 14th to come, the first asking if MPs want to leave without a deal on the 29th of March and the second on whether or not MPs want to send our Prime Minister across to the EU to bargain, or more accurately to beg, for an extension to the Article 50 process and for how long it should last.

Now, if you are in the London area, or for that matter anywhere in the country, next Tuesday, Wednesday or Thursday and want to make your voice heard, UKIP will be out in force outside Westminster while these matters are being debated and voted on.

Thursday may well prove to be the most critical of these days, as this is the currently planned date for MPs to vote on extending Article 50 - so delaying Brexit and many of those MPs will want that delay to be a very loooong one in order to give them the maximum time within which to frustrate the will of the people they purport to represent.

So the UKIP Leader Gerard Batten, the party's Deputy Leader Mike Hookem, UKIP Wales Leader Neil Hamilton and Lord Pearson of Rannoch will all be joining the protest on that vital Thursday.

Please join them if you can!

And all the signs are that Theresa May's Brussels or Merkel authored Withdrawal Agreement will be voted down again on Tuesday.

So it is inevitab..

It looks like tempers are fraying among our political classes as they try to locate the impossible - a political solution to the Irish Border Backstop issue.

Do you remember when everyone was having a pop at the US President Donald Trump for taking to Twitter to get his message across and almost conducting national and international policy with it?

For some reason, the EU chief Brexit negotiator, Michel Barnier, published five consecutive Tweets putting out his latest ideas on the backstop.

Now, I've done a quick trawl back over his account and can't see where he's ever done anything like that before.

Now these ideas have already been rejected by the UK, as it would mean treating Northern Ireland differently to the rest of the UK should the backstop be triggered by putting a customs border in the Irish Sea.

The UK Brexit secretary, Stephen Barclay, Tweeted back:

"With a very real deadline looming, now is not the time to rerun old arguments. The UK has put forward clear new proposals. We now need to agree a balanced solution that can work for both sides."

I've also had a quick look back over his Twitter account too and this one also seems to be more direct than his usual and out of character with previous Tweets.

The DUP said Barnier's offer was neither 'realistic or sensible' and Boris Johnson - remember him? - said that the EU was trying to 'annex' Northern Ireland.

The Leader of the House of Commons, Andrea Leadsom, told Reuters:

"There is still hope, but I have to say I’m deeply disappointed with..

But the party's top dogs have now asked those bringing an amendment forward next week for a referendum to be held, to put their plans on hold until after the fate of the Merkel authored Theresa May deal is known.

But here comes the Labour Party mixed message.

The Times reports that the shadow foreign secretary, Emily Thornberry, has said that it would oppose any Article 50 extension that would lead to the UK engaging in EU parliamentary elections.

That of course removes a second EU referendum from Labour Party strategy, it doesn't just put it on hold.

And a Reuters analysis of public comments made by MPs does suggest that there is no appetite for a second referendum in the Commons anyway.

Now the UK thinking is that we could maybe extend Article 50 up until the opening of the new EU parliament on the 2nd of July. But as I pointed out in a previous video, legal advice given to German MPs indicates that any extension of Article 50 that encompasses the MEP elections on the 23rd to the 26th of May, would probably require the UK to participate.

This means that Berlin might well oppose any extension longer than 54 days. And as EU27 unanimity is required for an Article 50 extension, it only takes one to veto it.

Then you have to factor in the reasoning for any such extension. If it's just so that UK politicians can bicker amongst themselves a bit longer, then what's the point?

But, if it's to tie up the loose ends on Theresa ..

Theresa May has now begged for the help of the European Union in getting her deal through the House of Commons in the form of a public speech in Grimsby.

And the bit in her speech that got tongues wagging was when she said:

"Next week, Members of Parliament in Westminster face a crucial choice. Whether to back the Brexit deal – or to reject it. Back it and the UK will leave the European Union. Reject it and no one knows what will happen. We may not leave the EU for many months. We may leave without the protections that the deal provides. We may never leave at all. The only certainty would be ongoing uncertainty. Months more spent arguing about Brexit, ...."

She's trying to convince those on the fence that without her deal, whatever happens, there will be more confusion. To the Remainers she's saying that unless they vote for her deal then we'll be out without a deal and at the same time she's dangling the threat of no Brexit in front of the Brexiteers unless they accept her deal.

The real pressing question that comes first is - do we want Theresa May's deal? Yes or no. We should forget what comes next and concentrate on that one horror.

And the answer should be a resounding no!

Especially given a report issued today by the House of Commons European Scrutiny Committee headed up by Brexiteer Tory MP Bill Cash.

This unanimously agreed report highlights some damning shortcomings in the Withdra..

"Just as MPs will face a big choice next week, the EU has to make a choice too. We are both participants in this process. It is in the European interest for the UK to leave with a deal. We are working with them but the decisions that the European Union makes over the next few days will have a big impact on the outcome of the vote."

Note her use of the phrase "European interest", not "EU interest".

But the Eurocrats have already said they're not going to play ball by changing anything in the Irish border backstop protocol, so I see her words falling on deaf ears.

But what should really get people to sit up and listen, especially all those wet Tory MPs who still support the PM's deal, is that those involved on the EU side of the negotiations are claiming that our Attorney general, Geoffrey Cox QC, told them that the backstop as it stands would breach the human rights of those living in Northern Ireland.

Now, I did a video on this way back in November last year, I've left a link to it in the descriptions box below. Briefly though, the backstop as it stands could interfere with the human right of self determination, which would be a violation of Article one of the International Covenant on Civil and Political Rights (or ICCPR).
