As we all now know, Boris Johnson had three letters sent to the EU as a result of the Letwin amendment being voted through by the House of Commons.

Now Boris and his team had always said the PM would obey the letter of the law and he did.

He sent the pre-canned letter to the EU Council president, Donald Tusk as he was required to do under the Benn Surrender Act, but it was not signed by him.

It was sent with a covering letter from Sir Tim Barrow, the UK permanent rep to the EU.

This letter said please find attached a letter sent as required by the Benn Act and also that legislation would be placed before parliament to move towards a position where the Withdrawal Agreement can be ratified.

Boris Johnson then also sent a letter from himself as Prime Minister to the EU Council president as well as the EU Commission president Juncker, the EU parliament president Sassoli and all EU27 leaders.

This letter said that he would press ahead with trying to get his deal through by the 31st of October as well as saying that:

"While it is open to the European Council to accede to the request mandated by Parliament or to offer an alternative extension period, I have made clear since becoming Prime Minister, and made clear to Parliament again today, my view, and the government's position, that a further extension would damage the interests of the UK and our EU partners, and the relationship between us."

And he went on the say that:

"We must bring this process to a conclusion so that we can move to the next phase and build our new relationship on the foundations of our long history as neighbours and friends in this continent our people's share. I am passionately committed to that endeavour."

So Donald Tusk has got the letter and said he will get back to us after he has consulted with EU leaders on how to react to it.

Now, there have been rumblings from some like the French President Emmanuel Macron, that an extension request could be vetoed, but the general consensus amo..

For those that haven't heard, MPs this afternoon voted to delay Brexit again.

Please note - that at the end of this video I should have said 312 votes not 302.

The House of Commons voted this afternoon by 322 votes to 306 to delay Brexit once more - and I have to ask what is the poor long suffering electorate and business community going to make of that?

This came about because MPs voted for the amendment to the government motion that says the legislation for the Withdrawal Agreement to become law must be scrutinised and passed prior to MPs voting to accept it. This is the Oliver Letwin amendment.

This turned what was meant to be a meaningful vote on the deal into a meaningless vote.

But be aware the Letwin amendment does not reject the Withdrawal Agreement, it just kicks the can further down the road with what Remainers hope is an Article 50 extension so they can do maximum damage to both Brexit and Boris.

Therefore, as MPs have not voted to accept the deal today, the Benn Surrender Act now requires the Prime Minister, Boris Johnson, to send an Article 50 extension request letter to Donald Tusk, the president of the EU Council.

And this has been the Remainer aim throughout - force extension after extension until we stay.

But what the Prime Minister has neatly done, is made sure it was MPs that publicly voted for the extension. And the names will be published very soon.

Now, when the Prime Minister stood up on a point of order to address the House after the vote, he thanked everyone and ..

With 13 days to go to Brexit Day, the judges are still hearing anti-Brexit court cases - but the Remainers lost two of them today.

So that's two court wins to zero, for the Brexiteers against the Remainers today then.

Earlier today, the civil rights organisation Liberty lost a case in the Court of Appeal in London to hold a hearing to force the Prime Minister, Boris Johnson, to obey the Benn Surrender Act and send an Article 50 extension request letter, if he can't get his deal agreed tomorrow.

Richard Hermer QC acting for Liberty argued that a hearing should take place before the October the 19th deadline, because if it was left until after the deadline then he said it would ".... be too late for the court to grant any effective relief".

But the application was turned down by the Lord Chief Justice Lord Burnett, Master of the Rolls Sir Terence Etherton and President of the Queen's Bench Division Dame Victoria Sharp - the same three judges that ruled against Gina Miller in her prorogation case in the High Court earlier this year, before the case went to the Supreme Court where it won.

And this evening the Outer House of the Court of Session in Edinburgh ruled against a case brought by arch Remainer lawyer, Jolyon Magham QC, that claimed the Boris Johnson Withdrawal Agreement was unlawful and so should not be put in front of MPs tomorrow for a vote.

A case I talked about in an earlier video yesterday.

Lord Pentland hearing the case said the petition put before him was 'of very doubtful comp..

Our MPs will be voting on this new Brexit deal forged by Boris Johnson tomorrow. Which way would you vote though? Deal or no deal?

Now what many people don't realise, is that there are two new documents involved in this overall agreement.

The first is the Withdrawal Agreement itself that dictates how we leave the EU and the second is a new Political Declaration document that sets out our future relationship with the EU.

Having read through the new amendments to the Withdrawal Agreement itself, all I can say is that, as far as I can see, it is the same Theresa May Withdrawal Agreement surrender treaty but with a change to the Irish border backstop and a reference to that new political declaration issued by the EU last night.

But there is one point that struck me. And that is that, as far as I can tell, the UK will still have to put in place UK domestic laws that permanently mirror six EU directives on equality and employment in Northern Ireland.

And it also looks to me like any taxes raised in Northern Ireland will rightly go to the UK Treasury.

Otherwise I just get the feeling that some backstop deck-chairs have been shifted about.

Now to the political declaration.

Without going through them both side by side it's very difficult to see what's changed - they look almost identical. But I found a couple.

One change in the new political declaration, is an added paragraph about the 'replacing' of the Irish border backstop.

But another amendment of note is that the old political declaration talke..

Just as the Brexit deal is agreed between the EU and the UK Prime Minister, out comes the news that makes the Benn Surrender Act totally irrelevant.

The text of the new deal struck between the UK Prime Minister, Boris Johnson, and the EU27 has been published and it's even longer than the last one.

The document that contains the revised text of the Withdrawal Agreement that Theresa May agreed, runs to 64 pages and adds reams of detail into what rules will apply to Northern Ireland only, after Brexit.

I've had a skim through it, but I haven't had time to compare it to the original so am in no position to say what I think of it yet.

Except that being me, I just think that if different rules apply to a part of our country after we've left - then the question is, have we achieved a full and proper Brexit.

And no-one seems to be talking much about the £39 billion so-called Brexit divorce payment either.

Now, most Remainer MPs will have been planning to force Boris Johnson to get an Article 50 extension via the Benn Surrender Act, before getting an amendment to the vote on the deal itself on Saturday, or an amendment to the Queen's Speech, for the Boris Johnson Brexit deal to be put to a confirmatory referendum against remaining in the EU.

But, they should have listened to Michael Gove when he appeared on the BBC2 Politics Live show today and when asked what he would do if MPs voted for a second referendum he said quite clearly and categorically that they won't be voting for a second referendum.
..

With everything else that's going on that affects the UK economy, you might have missed that the average price of a house in the UK hit a new high in August 2019.

According to the latest data from the Office for National Statistics, the price of an average house in the UK rose to £234,853 in August.

This is an increase of some £3000 on a year ago and about £1,900 up on the previous month.

Every country within the United Kingdom saw average house price growth, with:

Wales seeing an increase of 4.5% to £168,000.

Scotland saw a 1.6% growth to reach £155,000

In England prices increased by 1.1% where the average house price is now £251,000

And in Northern Ireland prices rose by 3.5% over the year to Quarter two and Northern Ireland remains the cheapest UK country to buy a property with an average house price of £137,000.

But within the English regions, the picture is more mixed.

Over the year to August 2019, the North East saw the largest average house price rise of 3,3%, followed by the North West with a rise of 3.1%, then the East midlands with 2.6%, followed by the West Midlands with 2.4%, Yorkshire and the Humber with 1%, the South West with 0.9% and the East with 0.1%

Then we go into negative territory where the South East saw house price falls of 0.6% and London saw losses of 1.4%.

When looking at London in more detail, inner London has been seeing house prices falling since January 2018, while outer London's prices have been falling since about September 2018.

But inner London is se..

I just have to ask this, in their desperation to stop Brexit in any form, are the Remainers just about to destroy their own case?

Just before I go into the main topic of the video, the news this morning is that Brussels has said it is happy with the Boris Johnson Brexit deal.

But the DUP has just issued a statement saying they are definitely not happy with it, which throws a fair sized spanner into the works.

More on that later as it develops.

Now back to the Remainers.

They've already brought a case to try and stop a no deal Brexit, but now they're bringing a case against the government to stop this deal.

Now, please hang in there with me on this one, it might be a bit complex but, if I'm right, it will give Brexiteers heart - and give Remainers hurt!

Last night that anti-Brexit lawyer, Jolyon Maugham QC, put out a call to crowdfund his latest legal action to stop Brexit.

And in a Tweet he said:

"We believe the Government's proposed Withdrawal Agreement is contrary to section 55 of the Taxation (Cross-border Trade) Act 2018."

Now, that section of the Act, which is purely UK statute law, says:

"(1) It shall be unlawful for Her Majesty’s Government to enter into arrangements under which Northern Ireland forms part of a separate customs territory to Great Britain."

But, the Brexit negotiations can't become a binding agreement until both international law and UK law match - its foreign office rules and laid down in law. So, during the interim period while both sides work towards setting up t..

Earlier today, Brussels gave the UK until midnight tonight to get the full Brexit deal in place. But the latest news is that Eurocrats will now set up an emergency EU27 summit, if that deadline is missed.

Things are moving at pace in the talks now, with gossip about the deal either being dead or on the verge of agreement - and as I speak Jacob Rees-Mogg, the Leader of the House of Commons, has said he cannot confirm whether the Super Saturday meeting planned for this weekend will be held or not.

This ties in with news that the EU will call another emergency EU27 summit to discuss the Brexit deal, if the UK misses tonight's deadline for the planned summit in the next few days.

But the Guardian is saying that Boris Johnson is on the brink of a Brexit deal after making Irish border concessions.

And it further says that:

"A draft treaty could now be published on Wednesday morning, according to senior British and EU sources."

This, it is reported, will mean a customs border down the Irish Sea and that will inevitably lead to some hard negotiations having to be done with the DUP, the members of the European Research Group and other so called Spartan Brexiteers in the House of Commons.

But there are also reports of discomfort over the speed at which this is happening on both the EU and UK side of the talks.

Now, from a government point of view, having that Super Saturday meeting of MPs could well be critical. Because without it there can be no vote by MPs to agree the Boris Johnson Brexit deal.
..

Against all the odds Boris is managing to keep the Brexit negotiations with the EU on some sort of track, but also, just as importantly, he is slowly winning over support from both wings of the Brexit debate.

Could it really be happening? Could the Prime Minister, Boris Johnson, be on the verge of confounding his critics?

Is he about to agree a new or refreshed deal with the EU that he can then put to MPs and win the day with?

That prospect seemed almost impossible just a few weeks or even days ago.

According to one to the most ardent Tory Brexiteers, Steve Baker, talking to the BBC:

"Most of us, including me, overwhelmingly want a deal. We have got to be capable of getting there through a withdrawal agreement.

"The problem with the previous withdrawal agreement," he continued, "is it was capable of leaving us trapped in the orbit of the EU, a declining satellite of the EU with no benefits from leaving.

"Boris has had a dramatic shift towards a free trade agreement that would leave us a self-governing nation … So now really, the devil is in the detail … I'm really looking forward to being able to vote for a tolerable deal but, until we get the text, I cannot tell you what we are going to do."

And a group of some 18 Labour MPs have written to the EU asking them to work as hard as they can towards a deal.

Then there are other Labour MPs who have said they will take a serious look at anything Boris brings back.

The trouble for them, is that there have been rumblings in the Labour Party int..

The Queen's Speech that opened this next session of parliament started off with the statement that the government's priority has always been to secure Brexit on the 31st of October.

There are now only 17 days to go to Brexit and not all of them will be parliamentary sitting days.

In fact it's been confirmed on the Hansard website "...that the House of Commons debate on the Queen’s Speech will conclude on 22 October, meaning that votes will take place on 22 and possibly 21 October".

That's next Monday and Tuesday, when there could be as few as nine days left to Brexit Day.

Bear that in mind, as you consider how much has to be achieved for the UK to actually leave the EU on time, if we are to leave with a Brexit deal fully in place.

However the Queen's Speech states it quite clearly that it is still the aim to leave the EU on the 31st of October.

But the introductory text to the speech by the Prime Minister failed to mention the date of the 31st of October at all. What it did say though was such things as:

"People are tired of stasis, gridlock and waiting for change."

Then

"And they don’t want to wait any longer to get Brexit done and to answer that clarion call of 17.4 million people in the greatest exercise of democracy in our national history."

and

"As we leave the European Union..."

As well as

"And as we get Brexit done, so we will re-energise and unite our country."

But, as well as the date, the terms 'deal or no deal' or 'whatever happens' did not appear in the PM's own screed ..

So, while we wait for these intensive Brexit negotiations to progress over the next few days, what will be happening in Parliament?

Parliament will be reconvening today after a week of prorogation, with the Queen's Speech due to be delivered in the House of Lords at about 11:30 this morning.

The House of Commons will be open for business again at 2:30 this afternoon.

The Speaker then makes a brief statement about the duties and responsibilities of MPs - though I've rarely seen any attempt at brevity by this speaker, as flowery speech is more his style.

Anyway, after that comes the four centuries old tradition of what is called the first reading of the 'Outlawries Bill'.

The Outlawries Bill is, says the parliament website, "...a Bill which no Member presents, which has never been printed, and which is not intended to make any further progress".

All sounds a bit pointless, but according to a House of Commons fact sheet this procedure is of great constitutional significance because it "...preserves and proclaims the right of the Commons to deliberate upon a subject of their own choosing, without necessarily turning first to the matters which may be mentioned in the royal summons".

Meaning the House has asserted its right to first debate matters beyond what is in the Queen's Speech.

The House of Lords has a similar procedure using the 'Select Vestries Bill'.

After the Outlawries Bill first reading comes debate on the Queen's Speech until 10 pm tonight.

The Queen's Speech is normally debated..

I've always had that vague feeling in my guts that the Benn Surrender Act was seriously flawed - and I think I might have found out why.

It's funny when something doesn't stack up properly for you and you get that constant nag in your mind that something isn't quite right and that you should therefore keep digging, isn't it?

Well, I've had that feeling about the so called Benn Surrender Act for some time now. So I kept digging and I think I've found the gaping hole.

If there are any qualified lawyers out there who can put me right on this, or put some meat on the bones that Boris Johnson can use, please do chip in.

One thing I have to ask though, is why do some people refer to this Benn Surrender Act as the Benn Dover Act - I'm trying to work out what a Kent town has to do with it.

Anyway, just to refresh peoples' minds, the Benn Surrender Act was voted through by parliament in order, it is claimed, to stop a no deal Brexit.

What it does, is forces Boris Johnson to send a letter to the EU Council against his will and against his own government policy, to extend the Article 50 process.

Now, what the Act does, by stipulating that the prime Minister sends the letter, is make Boris Johnson the UK representative for this exercise.

It is there in statute law, the PM, Boris Johnson, must send the letter so is our authorised representative by being both the head of government and having the force of this statutory law behind him.

Now, those that drafted and enacted this legislation, that is the ..

There is talk that whatever the outcome of the Brexit talks, the Remainer MPs are going to oust Boris and possibly replace him with the Speaker John Bercow.

There is a lot of speculation about what the deal that Boris is currently negotiating looks like, but you can rest assured that there is a hard core of our pro-EU MPs who will oppose it however good or bad it is.

Up until now the Remainer MPs had been stymied by the leader of the opposition, Jeremy Corbyn.

Now, the Remainer MPs think Corbyn wouldn't be able to command a majority for a government of national unity and want someone else.

But until now Corbyn has stuck firm saying it's either him or no-one.

But the latest news is that he might be prepared to stand aside for a short time as long as it was for someone who wouldn't end up causing his demise as the leader of the Labour Party.

And on that basis the Sun reports that the Labour Party wouldn't be averse to Bercow taking over.

The emerging idea is for Bercow to be installed as the head of a 'cabinet of all talents' made up of what is being described as 'clean skins', i.e. those MPs not too connected to party politics who would therefore they claim, have the national interest at heart.

That would mean excluding any of the current party leaders and also give a large role to those who are standing down at the next election.

But by putting John Bercow in place as caretaker PM they would be handing the reins of power over to an pro-EU MP who has shown his anti-Brexit credentials duri..

The Queen's Speech tomorrow is expected to contain new plans to tackle electoral fraud.

This will include the requirement for all voters to show some form of photo ID before they can vote, as well as further measures to limit proxy voting and stopping the ability of political parties and activists to harvest postal ballots.

These new laws will be brought in by an 'Electoral Integrity Bill' designed to clamp down on ballot box fraud.

So you will be expected to take your driving licence or passport along with you to the polling station the next time you vote.

And if you cast votes by proxy for other people, you'll be limited to a maximum of two.

And political parties and activists will no longer be able to go around collecting postal ballots direct from voters and then hand deliver them to the polling station on election day.

There is also expected to be a system for voters without passports or driving licences to get a free 'electoral ID' from their local council offices.

The Telegraph quotes a government source as saying:

"A secure electoral system is vital. By changing the law to require voters to show some ID, as they do in many other daily activities, and taking steps to cut down proxy and postal voter fraud, we can ensure that everyone's vote counts and strengthen public trust in our democracy."

I'm hoping that postal votes will also be made much harde..

It turns out that the Labour party has lost over 45,000 members in the year to December 2018 and had a financial shortfall of £655,000 in that year.

And the Times reports that this has led to fears amongst the Parliamentary Labour Party that they are 'ill-prepared for a general election'.

So, that could partly explain why the narrative is now turning towards having a second EU referendum, before a General Election.

After all, it would provide an Article 50 extension with some breathing space to rebuild the party and its finances, whatever result the referendum threw up in the end.

And the Shadow Chancellor, John McDonnell, hasn't helped the Labour Party cause, by telling Alastair Campbell in a GQ magazine interview that he couldn't see either Corbyn or himself staying on, if they lost the next election.

I mean, how defeatist is that?

Surely he's meant to be bigging the Labour Party and its leader up as the chances of having an election increase - well some people see an election on the horizon anyway.

As a senior member of the party hierarchy it's his job to back the party to the hilt and always dismiss out of hand, any talk of electoral failure.

It's his job to talk about what they will do in government and not speculate about failure - at all!

But he doesn't seem to have done that, which is both interesting and revealing..

If this is the Boris Johnson Brexit plan, then it looks fraught with risk.

News is emerging that Boris Johnson is planning to use this special sitting of MPs next Saturday the 19th of October to give them a chance to vote on whether to pursue his new Brexit deal or to once again extend the Article 50 process.

The Times says:

"The prime minister is preparing to hold a vote on his deal on the “Super Saturday” sitting of parliament as he challenges members to endorse his approach or force through a Brexit delay."

Now, this would require Boris to table his new deal, which will become the new Withdrawal Agreement, for both MPs and Lords to read beforehand.

It would also, much more importantly, require him to table a substantive and amendable motion before the House of Commons prior to Saturday.

And this is where the fun will start. With the first question asked being, "have you sent the Benn Surrender Act Article 50 extension request letter yet?"

Now, as I said in a very recent video, polling suggests that Boris will fly through to a very comfortable win in a general election, if he's taken the UK out of the EU either with or without a deal by the 31st of October. But even a short delay will drag his Conservative Party back into hung parliament territory.

The opposition and Remainers will therefore obviously work as hard as they can to prevent such an outcome.

So, the amendments will flood in and I would guess that most will be calling for an Article 50 extension to be requested for the purp..

It looks like Boris Johnson and the Conservative party are still flavour of the month.

Boris and the Tories, sounds a bit like a pop group, doesn't it, anyway, Boris and his Conservative Party seem to be cementing themselves as the favourites to win the most seats in any upcoming General Election.

The latest Westminster Voting Intentions tracker from the pollsters at YouGov, show that over the last five poles the Tories have managed to maintain their position as top dogs with a steady upward trend.

As you can see from this graph of the last five polls between the 10th of September and the 9th of October.

The blue bar on the left of each group is the latest poll.

So the Tories are doing well, but Jeremy Corbyn's Labour Party appears to be stagnating in second place - just, with the Lib Dems still hard on their heels but showing signs of a wane in support.

Nigel Farage's Brexit Party is still in fourth place, but with only 12% which could mean the party is currently outside of the zone needed to win seats, which seems to normally start at about 15%.

And when looking between Boris Johnson and Jeremy Corbyn as to who would make the best Prime Minister, Boris has increased his standing to 41%, which is 20% clear of Corbyn.

But all this could change very quickly. Especially if the rumours are correct, that Boris Johnson's new Brexit deal leaves Northern Ireland inside a customs union with the EU, so potentially becoming the Brexit sacrificial lamb.

As Nigel Farage Tweeted earlier:

"I don't kn..

News is developing that the UK and EU have had some form of Brexit breakthrough, as Michel Barnier has been given the green light to get the talks into the intense 'Tunnel' phase.

There are hopes that some sort of deal can now be done to break the Brexit impasse, because the EU chief Brexit negotiator, Michel Barnier, has been given the go ahead to intensify the negotiations.

This came it seems as a result of a meeting between the UK Prime Minister, Boris Johnson and his Irish counterpart, Leo Varadkar, which produced optimistic noises and signals from both sides.

However, we are still being warned that there is a long way to go and that there are no guarantees.

This will come as welcome news to the now Brexit weary public though, but as ever the devil is in the detail.

There is talk that this is just Theresa May's Withdrawal Agreement surrender treaty with a tweaked backstop and that the rest will be essentially the same. We'll just have to wait and see on that.

But it is the House of Commons that comes next. With MPs having to vote for both that Boris agreement and also for an accompanying but separate framework for the future relationship, the so called political declaration.

Then after that, before the agreement can be ratified, a complex Act of Parliament has to be passed, which contains provision for the implementation of that withdrawal agreement.

That says to me, that we would need what is termed as a 'technical' several months long, Article 50 extension to complete all that work...

There you have it, a vote for the Labour Party is a vote for a second EU referendum - and poor old Jo Swinson will see support for the Lib Dems start to implode.

The Labour Party leader, Jeremy Corbyn, has decided that the 2016 EU Referendum that the vast majority of politicians and parties told us was once in a generation and never to be repeated event, was actually just a worthless exercise.

He has just told 17.4 million voters that they do not matter by saying that if his party got into power they would immediately legislate for another EU referendum.

Here's what he said in Northampton earlier today:

"A Labour government will immediately legislate for a referendum. That referendum will not be a rerun of 2016. No-one knew what a deal with the EU would look like back then and the prospect of no deal was dismissed out of hand by leading leave campaigners, including Boris Johnson and Michael Gove at the time.

"This time the choice will be between leaving with a sensible deal, or remaining in the EU.

"Two clear options, both agreed with the EU. No false promises, no bluster."

And then came the pinkest of all pink elephants, a real unicorn, he actually said the following:

"So, within three months of coming to power, a Labour government will secure a sensible deal based on the terms we've long advocated and discussed with the European Union, trades unions and businesses.

"Including a new customs union, a close single market relationship and guarantees - absolute guarantees of rights and prot..

So, it seems there are plans for the Prime Minister to use a second letter to the EU Council to get round the Benn Surrender Act.

In news that seems to have lit the Remainer blue touch paper, the Business Secretary, Andrea Leadsom, yesterday told ITV's Peston programme that it was absolutely reasonable for the Prime Minister Boris Johnson, to follow up the Benn Surrender Act Article 50 extension request letter, with another one cancelling it.

This has been deemed by Remainer campaigners and lawyers as both unreasonable and unlawful, with the Shadow Brexit Secretary, Keir Starmer, Tweeting:

"Andrea Leadsom’s comments are neither the spirit nor the letter of the law. If there is no deal by the end of next week, the Prime Minister must ask for, and accept, an extension. One letter. No equivocation."

But Starmer was quite happy of course to see The Speaker, John Bercow, ride a coach and horses through House of Commons rules, wasn't he? And no-one seems to care that Speaker Bercow was recently talking to the EU Parliament President about Brexit, do they?

Anyway, Any supplementary letter from Boris would be hauled straight off to the Supreme Court to be quashed, under the principle that the government cannot do anything that would 'frustrate' an Act of Parliament. So unless it has some real legal weight behind it, that second letter would probably be a fruitless exercise and a waste of paper, ink and a stamp.

But, as they say, nothing ventured, nothing gained.

Now, the former Foreign secretary, ..

It seems that the Speaker of the House of Commons, John Bercow, has been having a tete a tete with the new EU Parliament President.

John Bercow who, as the Speaker of the Commons, is meant to be unbiassed and impartial, had a meeting with David Sassoli, who took over as the new President of the EU Parliament on the 3rd of July, and Mr Sassoli said they were both on the same wavelength about how Brexit should be dealt with.

This revelation came about as Mr Sassoli was making a statement to the EU Parliament this afternoon, in which he said that he had engaged in 'fruitful discussions' with John Bercow and that he also told him that in his view "... any request for an extension should allow the British people to give its views in a referendum or an election".

And then he said:

"Speaker Bercow and I were very much on the same wavelength on the importance of the respective roles of our parliaments in managing Brexit."

This set in train a barrage of Tweets from Brexit Party MEPs, including the party leader Nigel Farage.

Richard Tice Tweeted:

"BREAKING: here in Brussels new President Sassoli admits in chamber that he has bypassed the UK PM and Govt and is now in direct discussions with Bercow about Brexit negotiations. He refused to take my urgent question on what authority they had to have these discussions."

And Nigel Farage Tweeted:

"Here in Brussels, new Euro parl President David Sassoli confirms a meeting with John Bercow in which they agreed to work to prevent a clean break Brexit. What ..

It is reported that the government is taking legal advice that could allow Boris to stay on in Number Ten and force a General Election, even if he falls to a vote of no confidence and a caretaker PM is identified by a vote of MPs.

Before I get into the main subject, just to let you know that the Court of Session in Edinburgh has decided that an order to force the Prime Minister, Boris Johnson, to comply with the Benn Surrender Act, is not yet necessary. The court has decided to wait until the 21st of October to see if it needs to issue such an order then.

Now, it's become obvious that the current set of mostly Remainer MPs in the House of Commons, as well as the official opposition, are running scared of a General Election for fear of being thoroughly trounced by a Boris backlash vote.

But they are instead looking at ways of commandeering the House so as to push through their preferred option of having a second EU referendum, prior to letting the public loose in a general election.

And one way of doing this would be to have a Vote of No Confidence in the Boris Johnson government, get him removed by the Queen, if he refuses to resign, and install someone else to run a government that would then work towards that referendum.

And this possibility is being looked at because of the Fixed Term Parliament Act, which says that an early general election can only be called 14 days after an unresolved vote of no confidence in the government, or if 434 or more MPs vote for one.

Before the Fixed Term Pa..

Put Saturday the 19th of October in your diaries, as this will be the day that MPs have a special crunch Brexit sitting to decide the way ahead for Brexit.

Preparations are being made for MPs to have a special sitting on Saturday the 19th of October, just 12 days short of Brexit Day, which will in all probability be the crunch date for the future of Brexit.

MPs are currently due to return to the Commons on Monday the 14th of October when parliament ends this prorogation period and the first item on the agenda will be the Queen's Speech, followed by debates and votes on it.

Then there's the EU Council meeting where we should have it confirmed by the 17th of October, that the latest UK proposals for a deal have been rejected.

Then, with no deal and a parliament that will not vote for any deal because it wants us in the EU, we have the 19th of October, which is the latest date by which the PM, Boris Johnson, can send the Benn Surrender Act Article 50 extension letter. As well as now this special sitting of parliament.

This does look to me like a move to make MPs openly make the decision as to what happens next.

And, if I'm right, MPs will be staring at four options: force Boris to ask for an Article 50 extension for an as yet ill-defined reason, accept a deal, Revoke the Article 50 letter or accept a no deal Brexit.

What will parliament do, in the full knowledge that to extend Article 50 for further negotiations would mean negotiating a deal that would have to end with the forced separation o..

News is emerging that the Prime Minister, Boris Johnson, is prepared to take his Brexit case to the Supreme Court.

I said in a video yesterday evening, that Brexit might be played out in a massive high stakes court battle coming to your TVs very soon.

And the news is this morning that we might be seeing just that, with the Telegraph saying that several government sources have said that the PM is ready to go to the Supreme Court to avoid having to write that Benn Surrender Act letter that begs the EU for another Article 50 extension.

This, says the report, could mean the PM giving evidence personally in court to try and make his case.

And it seems that the preference is for Boris Johnson to be seen to be forced to send the letter as a result of a court order, rather than to just acquiesce to the Benn Surrender Act and do so voluntarily.

The Telegraph also says that one government source said the PM needed to find a legal way of saying he won't be writing that letter at least five days before Brexit Day.

But with the Court of Session in Edinburgh due to say what legal sanctions would be imposed should the PM not agree to write the letter and accept its result - as well as the Supreme Court's seeming willingness to bend the rules in favour of Brussels, I won't be holding out much hope.

Especially after the Supreme Court President, Lady Hale, was caught apparently boasting at the Association of State Girls’ Schools conference on Friday, about how she took Boris down.

With a government source ..

There is a lot of speculation out there that the Hungarian government might be the knights in shining armour, that ride their white steeds to the rescue of Brexiteers.

The Prime Minister, Boris Johnson, held an emergency cabinet meeting yesterday, at about the same time as a Hungarian minister and ambassador were thought to be in the building. And video footage has emerged of the Hungarian foreign minister leaving the Cabinet Office Friday morning.

Not only that, it is reported that the Cabinet Minister, Michael Gove, together with two other unnamed ministers met with the Hungarian foreign minister the day before.

This has led to speculation that the Hungarian government might be working with the UK government with the intention of vetoing any further Brexit extensions.

As you will know, it only takes one of the other EU27 member states to reject an Article 50 extension request to stop the whole Remain thing in its tracks.

And Hungary is thought to be one of the UK's best allies where Brexit is concerned.

So, some sort of agreement might well have been reached, with some pundits joining up the dots by pointing to the legal memo sent to the Court of Sessions yesterday stating that it is government policy to send that Article 50 letter in a accordance with the Benn Surrender Act, if there's no deal by the 19th of October, as well as the later statements by both the PM and his advisor, Dominic Cummings saying that it's either this new deal or no deal on the 31st of October while also ruling ou..
