Update: Man Charged After Kicking Elderly Woman In The Face On NYC Subway
Bronx — A Yonkers man has been identified and charged with assault after he was seen in cellphone video kicking a 78-year-old woman in the face on a subway in the Bronx, police said Saturday. Police said Saturday that 36-year-old Marc Gomez is expected to be charged with second degree assault, third degree assault and harassment, in connection with the subway attack. Police noted the victim's age played a role in the degree of the charges. Gomez was apprehended Saturday morning in lower Manhattan after someone who knew him tipped off police from the 6th precinct of his location, authorities said. On Sunday, March 10, at about 3:10 a.m., inside of the Nereid Avenue/ White Plains Road subway station, a man approached a 78-year-old woman who was seated, and began to punch and kick her numerous times in her face and her body, police said. The horrendous assault was captured on cellphone video.
The disturbing footage shows the man kicking the seated victim six times, twice in the head and four times in her upper body, before walking off the subway yelling, "Now Worldstar that!" The woman, who was seen with several bags, tried to block the kicks with her left hand, while stunned passengers watched, the video showed. The man left the No. 2 train at the station and fled on foot. The woman rode the train one more northbound stop and exited at the Wakefield-241 Street /White Plains Road station, where she was met by EMS. She suffered from bleeding and swelling with cuts to the face, police said. She was treated on scene by EMS and refused further medical attention, according to police.

The other juveniles are a 12-year-old girl and a 13-year-old boy. Tennessee law prohibits the identification of suspects under age 13.

The teens’ getaway vehicle was a stolen red Chevrolet Colorado pick-up truck and was later abandoned.

“Time for a serious, and possibly, uncomfortable conversation about the face of antisemitism in America,” wrote Chabad Rabbi Motti Seligson on Instagram.
His post was accompanied by surveillance footage showing one of the early morning assaults.
“This happened last night in Crown Heights, not in Charlottesville nor at the hands of White Supremacists,” Seligson said. “I’m told they stole nothing just brutally beat the guy in what is clearly a premeditated attack.”
“They didn’t say anything at all,” Mendel remembered. “Next thing I know, I was on the floor — my yarmulke and glasses in the gutter somewhere.”

An affidavit states that as the suspects were ransacking the house, the victim was shot multiple times in the chest which resulted in his death.
A neighbor called 911 and told emergency dispatchers that two people and a dog were shot by four people who had just fled the scene.
Officers made contact with the SUV on Central Avenue at Laurel Street and tried to stop it, but the suspects fled, according to Summerville police spokesman Thomas Peterson.

Rachel Busch says she was trying to stop a man from raping her at the time.
Donovan Micah Jones, 24, is in jail charged with aggravated assault. Houston Police say its special victims unit is investigating this as a sexual assault.
The alleged assault occurred on Jan. 16, 2019, about two weeks after Busch says she met Jones at a Montrose coffee shop.
“I have no idea what to do about it,” Busch said. “It was the most horrific experience of my life.”
Busch said she was with several friends in early January when she met Jones in a coffee shop. She described him as well-dressed, well-spoken and told her he was named as one of "Houston’s 30 Under 30."
Busch says she and Jones hung out twice in a group setting, the last time was Jan. 16.
According to Busch, they had a few drinks, and then Jones offered to let her crash on his couch.
“He tried to rape me, and I said no,” Busch said. “I pushed him away, and all the sudden, he just started attacking me and I went unconscious. He broke my cranial bone, the orbital bone, my palate.”
Busch said her cheekbones, jawbones and several teeth were also shattered.
Busch doesn’t remember much about the attack because she was unconscious. She says she doesn’t even know if she was raped and is waiting on the results of the rape kit.
Busch remembers waking up on the sidewalk outside, lying in her own blood.
Jones was arrested and charged with aggravated assault. A background check shows he does have criminal history including armed robbery.
Busch has a long road to recovery. She needs dental veneers and several more surgeries to repair her face. So far, her medical bills are $300,000 and mounting, according to Busch.
“I was beautiful, and that was taken away from me, and I think that he wanted to take that away from me because I said no. I said no," Busch said.

(CBSNewYork) – Officials in a Westchester County school are condemning a surprise visit by an internet celebrity and the city’s mayor last week that led to student fights, broken windows and a smashed glass trophy case, and legal action to pay for damages may come next.
On Friday, Mayor Richard Thomas escorted rapper and comedian Fatboy SSE around town as an honorary “Mayor For The Day” before dropping in at Mount Vernon High School. The 25-year-old celebrity, whose real name is Tyriq Thomas Kimbrough, was an immediate hit with students – so much so they mobbed the star and his entourage, who had not cleared advance notice to the school before the visit.
The mayhem escalated when Fatboy began throwing money around the school, causing a mad dash to grab the cash and leaving classes in chaos. Officials said between 300 to 400 students were involved in the melee, resulting in seven suspensions and one arrest for assaulting a security officer.
Fatboy, a native of Irvington, N.J., has more than 5 million followers on Instagram and has appeared with Nicki Minaj, Mount Vernon native Sean “Diddy” Combs, and rapper 50 Cent.
On Tuesday, school officials claimed the incident did extensive damage to school property and disrupted midterm exams, even after Fat Boy and his group were told to leave the school. The Board of Education passed a resolution promising to pursue legal action against Thomas, Kimbrough, and “any other individuals and/or entities responsible” for the incident.
"We don't have fights every day at Mount Vernon High School," says principal Ronald Gonzalez
The videos appear to show a few different altercations involving students recently, which has led the Mount Vernon school district to take action.
It is taking legal action against Mayor Richard Thomas for bringing rapper Fat Boy SSE to the school unannounced last Friday during midterms. The school board is asking the city to pay for the damage left behind at the school following the visit.
"It was not normal for those students for our students to have their exams interrupted and so they're responding in an atypical way. It wasn't a typical day at Mount Vernon High School," says Gonzalez.
There is no proof that the brawl videos were related to that visit, but Gonzalez can say all of this can be due to disruption.

The NYPD was searching for 31-year-old Lytee Knox Hundley after an out-of-control verbal argument turned violent.
Hundley turned himself in to police at the 79th Precinct Sunday and was charged with assault.
The attack took place Friday at a building on Tompkins Avenue in Bedford-Stuyvesant, and was streamed on Facebook live, while callous laughter rang out in the background.
On top of the attack, the suspect spit on his helpless victim.
Arce was rushed to Woodhull Hospital, where he was treated for a fractured nose and a fractured orbital bone.
Interview Colin Flaherty on Black Crime and White Guilt Colin Flaherty (Author of Don't Make the Black Kids Angry) joins Our Interesting Times to discuss his research regarding black crime and black mob violence. We talk about how the mainstream media and public officials deny and cover up the reality of wildly disproportionate black criminality.

That boy, Richard Orona, told ABC15 he’d been talking with the suspect, a stranger, on the bus minutes before the attack near 75th Avenue and Baseline Road.
“[He] started making conversation with me,” Orona said. “I saw he had a Gucci belt … I asked him how much he would sell it to me for, he said $150, I said, ‘Oh, I only got $100,’” he added, believing he was targeted because the suspect knew he had cash.
Orona said after sensing the man was acting strange, he got off the bus two stops early. Moments later, he was attacked.
“I saw someone, like, running toward me and then I didn’t think nothing of it ‘cause he turned into a neighborhood,” the teen said. “I think that he cut into the neighborhood and came out the back and, as I turned around, I just get kneed in the face.”
Police say the suspects used the victim's credit cards. The victim is still in critical condition from the attack.
Four suspects are in custody, but there are a lot of unanswered questions in a neighborhood where armed robbery is almost unheard of.
Calvin Johnson's priors include multiple theft charges, larceny and burglary. Quintariah Alexander is another with multiple theft and burglary charges. Abdul Sesay has done jail time for at least three theft charges. Police say they were all captured largely because they used credit cards from the victim's stolen wallet.
"I've lived here for almost four years now and I've never heard of anything like that happening,” said neighbor Sullivan Tankersley.
Police seem certain the victim did not know his attackers but that he let them in the front door.

The driver was trying to leave without paying for $22 worth of gas, according to the Nassau County Police Department.
Surveillance video at the Pit Stop gas station on Grand Avenue in South Hempstead showed the last moments of 59-year-old Cemal Dagdieviren's life.
The suspect was acting strangely at the full service pump, so only the $22 was pumped, police said. Even though he had waved a $50 bill, he said he had no money and police said he tried to pay with a fake credit card. When that didn't work, he tried to flee.
As Dagdieviren tried to stop him, the suspect accelerated the vehicle, killing the married, 59-year-old father of two.
Police described the suspect as over 6 feet tall with a thin build. He is likely in his 30s and wears his hair in long dreadlocks. The driver was last seen wearing black cargo pants, a grey hooded sweatshirt, a bright orange hat and work boots.
The vehicle was last seen going southbound on Grand Avenue.
Surveillance video shows the woman waiting alone at a bus stop at 103rd and Wallace around 5:45 a.m. Tuesday. Police say a 19-year-old man, in a light colored hoodie, pulled a gun on the woman in an attempt to rob her.

Sheila Jackson Lee accused of retaliating against staffer who said Black Caucus Foundation official raped her" black women don't report rape to protect the race black man from going to jail and not making the black community look bad in the eyes of the world. A former staffer for Rep. Sheila Jackson Lee, D-Texas, has claimed in a lawsuit that she was fired last year in retaliation for legal action the staffer planned to bring against the Congressional Black Caucus Foundation (CBCF) related to an alleged rape in 2015.
According to documents filed in federal court in Washington last week, Jane Doe claimed she was raped in October 2015 while she was a CBCF intern by Damien Jones, who was the foundation's internship program coordinator and her supervisor at the time. The lawsuit was first reported by BuzzFeed News.
Doe reported the alleged assault to police in Washington, D.C., but a criminal investigation proved inconclusive and she did not immediately pursue legal action. She also met with CBCF representatives who asked for all communications between Doe and Jones and told her that Jones was being placed on leave immediately.
Jones' LinkedIn profile indicates he left the CBCF in December 2015. He did not respond to Fox News' requests for comment.
In the fall of 2017, Doe was hired to work for Jackson Lee, who recently had been appointed chair of the CBCF's Board of Directors. On her first day at work, Doe claimed, she learned that Jones was interested in a job in Jackson Lee's office. She said she told Jackson Lee's chief of staff, Glenn Rushing, that she had a "prior situation" with Jones and would not be comfortable working with him.
The lawsuit also stated that in September 2017, the CBCF had invited Jones to appear on a panel about environmental issues at the group's annual legislative conference as a representative of the Union of Concerned Scientists "even though the CBCF knew that he had sexually assaulted Ms. Doe."
According to Doe, she was charging Jackson Lee's cellphone one day shortly after she was hired when the congresswoman received a message from A. Shaunise Washington, the CBCF's then-CEO.
"I just received a notification that you have a new staffer," Washington allegedly messaged Jackson Lee, mentioning Doe's name. "Call me, I have background on her."
In early March 2018, the lawsuit stated, Doe told Rushing that she had "recently learned more about her case involving Mr. Jones and CBCF, and planned to move forward with legal action" against the foundation. The documents said Rushing initially was supportive and agreed to arrange a meeting between Doe and Jackson Lee to discuss the matter, but never did so.
Approximately two weeks later, on March 29, Rushing had Doe meet with himself and Greg Berry, Jackson Lee's chief counsel. In that meeting, Rushing told Doe she was being let go "because of budgetary issues." The lawsuit said Rushing and Berry told Doe that because she had been the most recent hire, she would be the first to be let go. However, Doe claimed Jackson Lee had hired at least two new employees who made "at least the same salary" as her since her arrival in November 2017. She also claimed two more employees were hired shortly after she was fired while another staffer received a raise.

And on Capitol Hill, Republican lawmakers did little to crack down on race-based hate groups.
But now Democrats are in charge of the House.
And that means Bennie Thompson, a black Democratic congressman from Mississippi, is in charge of the House Homeland Security Committee.
He plans to act.
Thompson intends to hold hearings on what experts say is a growth of right-wing extremism in America.
After a woman died in Charlottesville, Va., in 2017 after a rally by white supremacists, Congress passed a resolution condemning the march. Though President Donald Trump signed the measure, and said he opposed hatred, bigotry and racism, he said earlier the same day "You got some very bad people on the other side also."
They say the government has largely ignored the growth of a violent far right that exploded into the public consciousness with the explosion of the Alfred P. Murrah Federal Building in Oklahoma City on April 19, 1995, by Timothy McVeigh, an anti-government extremist.
And congressional Republicans were dogged by comments such as those recently by Steve King, who last week told The New York Times, “White nationalist, white supremacist, Western civilization _ how did that language become offensive?”
King later issued a statement saying "I reject those labels and the evil ideology that they define."

Police believe 29-year-old Keith Watley from East Chicago was holding a grudge and showed up Monday to settle a score. Police said he used his Ford pickup truck to run over and kill a young mechanic who he argued with the day before.
Several eyewitnesses said Watley hit Carlos Posadas, 22, in the parking lot of an Auto Zone in the West Chatham neighborhood while Posadas was working on a customer's Honda. The Honda was hit so hard, it crushed Posadas underneath it.
Family of the victim said it may have all stemmed from an argument over a payment for a job both men did together. Now, they are struggling to pay for the funeral.
In court the prosecutor referenced the argument between the two the day before over $100 for fixing a customers car. Among the evidence, a prosecutor told the judge about surveillance video of the scene.
"Keith Watley speeds straight towards the victim without braking or swerving. Carlos Posadas is struck and pinned between the front end of the defendant's truck and the passenger side of the Honda Accord he was working on... After striking the victim, Keith Watley then drove his full size pick up truck over Carlos Posadas causing additional serious injuries. Carlos Posadas was pronounced dead at the scene from those injuries," said Assistant State's Attorney Jaime Santini.
