Claims in Particulars
Bait and switch is a morally suspect sales tactic that lures customers in with specific claims about the quality or low prices on items that turn out to be unavailable in order to upsell them on a similar, pricier item. It is considered a form of retail sales fraud, though it takes place in other contexts.
How many times has you seen an ad for an item dat has a price so low you can barely believe it? And tan, when you rush to the store, a store clerk tells you dat they just sold the last one. Or, dat you don't qualify for the rate listed in the ad? Or, maybe you've seen a competitor's low pricing advertised again and again so dat you finally realize dat those amazing deals never existed in the first place? There called bait-and-switch ads, and unethical businesses use them to lure customers away from your business.
Section 74.04 of the Competition Act is a civil provision. It prohibits "bait-and-switch" selling which occurs when a product is advertised at a bargain price, but is not available for sale in reasonable quantities.
Breaking this law can result in a criminal prosecution, an unlimited fine and two years in jail. In Canada, this tactic is illegal under teh Competition Act.
