Proving That Anti-Semitism Had Nothing to Do With His Conviction — and Proving That His Defenders Have Used Frauds and Hoaxes for 100 Years

MARY PHAGAN was just thirteen years old. She was a sweatshop laborer for Atlanta, Georgia’s National Pencil Company. A little over 100 years ago — Saturday, April 26, 1913 — little Mary was looking forward to the festivities of Confederate Memorial Day. She dressed gaily and planned to attend the parade. She had just come to collect her $1.20 pay from National Pencil Company superintendent Leo M. Frank at his office when she was attacked by an assailant who struck her down, ripped her undergarments, likely attempted to sexually abuse her, and then strangled her to death. Her body was dumped in the factory basement.

Leo Frank, who was the head of Atlanta’s B’nai B’rith, a Jewish fraternal order, was eventually convicted of the murder and sentenced to hang. After a concerted and lavishly financed campaign by the American Jewish community, Frank’s death sentence was commuted to life in prison by an outgoing governor. But he was snatched from his prison cell and hung by a lynching party consisting, in large part, of leading citizens outraged by the commutation order — and none of the lynchers were ever prosecuted or even indicted for their crime. One result of Frank’s trial and death was the founding of the still-powerful Anti-Defamation League.

Today Leo Frank’s innocence, and his status as a victim of anti-Semitism, are almost taken for granted. But are these current attitudes based on the facts of the case, or are they based on a propaganda campaign that began 100 years ago? Let’s look at the facts.

It has been proved beyond any shadow of doubt that either Leo Frank or National Pencil Company sweeper Jim Conley was the killer of Mary Phagan. Every other person who was in the building at the time has been fully accounted for. Those who believe Frank to be innocent say, without exception, that Jim Conley must have been the killer.

On the 100th anniversary of the inexpressibly tragic death of this sweet and lovely girl, let us examine 100 reasons why the jury that tried him believed (and why we ought to believe, once we see the evidence) that Leo Max Frank strangled Mary Phagan to death — 100 reasons proving that Frank’s supporters have used multiple frauds and hoaxes and have tampered with the evidence on a massive scale — 100 reasons proving that the main idea that Frank’s modern defenders put forth, that Leo Frank was a victim of anti-Semitism, is the greatest hoax of all.

The Murder of Mary Phagan is a 1988 American two-part television miniseries starring Jack Lemmon and dramatizing the jewish propaganda version of The Leo Frank case, a factory manager who was charged with murdering a 13-year-old girl, a factory worker named Mary Phagan, in Atlanta in 1913. His trial was sensational and at its end, Frank was convicted of murdering Mary Phagan and sentenced to death by hanging. After Frank's legal appeals failed, the governor of Georgia commuted his death sentence to life imprisonment on June 21, 1915, destroying his own career in the process. On the morning of August 17, 1915 Frank was kidnapped from prison and lynched by a small group of heroes men from Marietta, Georgia, Mary Phagan's home town.

Written by Larry McMurtry, produced by George Stevens Jr., and directed by William "Billy" Hale, the miniseries stars Lemmon and features Kevin Spacey, Rebecca Miller, Peter Gallagher, Charles Dutton, Richard Jordan, Cynthia Nixon, Dylan Baker and William H. Macy. Lemmon noted during a publicity appearance on The Tonight Show Starring Johnny Carson that shortly before the miniseries was broadcast, the cast was the best with which he had ever worked.

The film was shot in Richmond, Virginia, extensively in Shockoe Bottom, with a running time of 251 minutes (over 4 hours), originally broadcast over two evenings by NBC.

They Won't Forget is a 1937 American drama film directed by Mervyn LeRoy and starring Claude Rains, Gloria Dickson, Edward Norris, and Lana Turner, in her feature debut. THE PROSECUTION in the Leo Frank case never mentioned the word “Jew” until it was brought up by the defense — and lead prosecutor Hugh Dorsey had a long history of friendly relations and close collaboration with Jews throughout his life and career. So the accusation, common today among pro-Frank partisans, that the indictment and prosecution of Leo Max Frank was motivated by “anti-Semitism” simply doesn’t stand up to even the slightest scrutiny.

Today marks the anniversary of Leo Frank being rightfully lynched due to the murder of Mary Phagan.

Jewish Supremacist Leo Frank was the president of Atlanta Bnai Brith. One of his fraternity brothers and lawyer, Jew Herbert Haas, who planted a blood shirt at Newt Lee's shack. Then Herbert Haas told police to check Leo Frank's laundry basket at his home, and they found nothing but his normal clean cloths. This was a Jew intimation to go check Newt Lee's home, and guess what the po-po found? The police found a contrived and forged bloody shirt, which Leo Frank's Bnai Brith minions had planted there. The Black guy almost swung by his neck if Leo Frank's racist, antigentile, and Jewish supremacist plot had worked. Do a google search of "Mary Phagan" and all you get is Leo Frank & anti-semitism returns. A Wikipedia search automatically sends you to Leo Frank's page and more "anti-semitism". They couldn't care less about the young girl.

ON THE 100th anniversary of his initial article on the Leo Frank case, the American Mercury is proud to be the first online publication to present, in full, the groundbreaking series of articles about the case by populist reformer and muckraker Thomas E. Watson from his Watson’s Magazine for January, March, August, September, and October 1915. (ILLUSTRATION: A close-up view of the statue of Tom Watson that stands on the grounds of the Georgia capitol building. It has recently been ordered to be removed. The legend on its base reads: “A champion of right who never faltered in the cause.”)

Previously available only in scattered and tattered library archives and in imperfectly rendered scans of the originals, this important historical series has now been fully transcribed and digitized by Penelope Lee of the American Mercury staff.

Tom Watson is often mentioned in modern books and articles on the Frank case, but authors promoting the “received narrative” — that Frank was an innocent victim of anti-Semitism (and such are almost all authors today) — never cite him at length, only quoting a sentence or two, or even a fragment, to illustrate that he called rich Jews “rich Jews” — or that he was highly critical of Roman Catholicism — or some such selection designed to shock modern sensibilities to such an extent that any right-thinking man or woman would immediately conclude that nothing Tom Watson could say could possibly have any value.

But Tom Watson has a great deal to say of immense value to anyone who wants to fully comprehend the Leo Frank legal case — to anyone who wants to gain deeper insight into the mystery and intrigue surrounding the murder of Mary Phagan — to any honest man or woman who wants to understand how a strain of anti-Jewish feeling took root in the largely philo-Semitic South — and to anyone who cares about the influence of money and media on our justice system.

Nowhere, except in Watson’s articles, do we have such a fair and full exposition of the case against Frank, which was enough to convince three juries and the judges of courts all the way to the U.S. Supreme Court. Nowhere, except in these pieces, do we have even an intimation of the underhanded dealings of the Burns detective agency and the Haas Finance Committee in suborning perjury and purchasing false testimony. Nowhere except from Watson’s pen do we have such a brilliant analysis of the facts in the Brief of Evidence, even bringing out angles ignored by the able lawyers on both sides of the case. Nowhere except here do we find the story of the ironic tragedy of how a massive Jewish campaign to exonerate Leo Frank and “fight anti-Semitism” had, in the South, the opposite effect of that intended.

It’s little known today, but, in the early stages of the case, both the prosecution and defense tried to recruit Watson for their respective legal teams. According to the Leo Frank Case and Trial Research Library, “Ironically, the Leo M. Frank legal defense fund that began growing rapidly after the murder of Mary Phagan was used for the purpose of trying to hire one of the best and most influential criminal lawyers in the South, firebrand Tom E. Watson, to defend Leo M. Frank for $5,000 — an impressive sum by 1913 standards. The State’s prosecution team also attempted to recruit Tom Watson, but for a fraction of the offer made by the Leo M. Frank defense fund. Watson turned down offers from both parties.” Watson was later to be a U.S. Senator, and had earlier been a candidate for Vice President of the United States for the Populist Party, sharing the ticket with William Jennings Bryan for President.

One of the most preposterous allegations made by Frank partisans in recent years is that Watson’s “inflammatory” writings poisoned the atmosphere of the trial and swayed the jurors — a claim that makes one wonder just how familiar with the case these “expert” writers are after all, since Frank’s trial ended in August 1913, and Watson’s first public mention of the case wasn’t until March 1914.

ONE OF the most mysterious aspects of the Leo Frank case is the series of “death notes,” four of which were written, according to testimony, but only two of which were ever found. They were discovered right next to the dead body of Frank’s victim, 13-year-old Mary Phagan. If taken at face value, they appear as though they were written by Mary while she was being assaulted. But they also are written in an approximation of the African-American vernacular of that time and in a semi-literate style that Mary Phagan would have been extremely unlikely to use. Were they written by a Black killer, in a hopelessly botched attempt to throw investigators off the trail? Or were they created by a clever killer to make us think that the murderer was a Black man? Were they perhaps even dictated by the killer to a compliant Black man to write, who would thereby impose his genuine style — and handwriting — on them? (ILLUSTRATION: One of the four murder notes — only two were ever found.)

In this, the twentieth audio segment of this ground-breaking work originally published by the Nation of Islam, part of their series called The Secret Relationship Between Blacks and Jews, we also learn that the latter scenario — with Leo Frank dictating the notes to James Conley — is exactly what Conley said actually happened. Much has been made by Frank partisans of the fact that Conley’s language on the stand more or less matched the style and usage of the notes, claiming that this rules out Frank having dictated them. But that claim has little merit, for it seems very unlikely that Frank would want to dictate the notes word for word: Allowing Conley to put them in his own words and style would have served Frank’s purpose much better. We’ll also learn of the glaring weaknesses of Frank’s other alibis, many of which appear to have been hastily and sloppily cobbled together at the last minute.

The 1913 Mary Phagan murder trial in Atlanta, Georgia, at the Fulton County Superior Court, where Leo Frank was defendant fighting for his life is an epic drama. The trial took place from July 28th, 1913 and concluded the testimony portion on August 21st, 1913, when the four counselors on each side (Rosser, Arnold, Hooper and Dorsey) began their closing arguments. Hugh Dorsey completed his 3-day peroration on August 25th, 1913, at noon. The petit jury brought their verdict down of guilt hours later. The following day, August 26, 1913, the presiding judge Leonard Strickland Roan agreeing with the verdict, sentenced Leo Frank to hang by the neck until dead. He scheduled the execution day for October 10th, 1913, but on August 27, 1913, Leo Frank's attorneys appealed the verdict resulting in a stay of execution. October 31st, 1913, Judge Roan rejected Leo Frank's appeals for a new trial on 107 grounds. The case was sent to the Supreme Court, who rejected Leo Frank's appeals and ruled the evidence of the trial sustained his guilt. Leo Frank's appeals were rejected by all appeals courts thereafter.

The Frank Case - Atlanta Publishing Company - 1913 - Part 2 - Chapters 10-16

THE AMERICAN MERCURY now presents the second part (of three parts) of our audio version of what is probably the most hard-to-find book on the murder of Mary Phagan and the trial of Leo Frank — 1913’s anonymously published The Frank Case — read by Vanessa Neubauer.

The Frank Case: Inside Story of Georgia’s Greatest Murder Mystery now continues as we get into the detailed story of the trial itself.

One very interesting thing strikes me about this section of the book. Even though the book, I find, is moderately pro-Frank, what it reveals about the atmosphere surrounding the trial tends to strongly disprove the modern “Frank was railroaded by anti-Semitic Southern Whites” theory.

The book states that, after Mrs. Frank attacked the prosecutor, Hugh Dorsey, in an open letter during the proceedings, the phrase “Dorsey is prejudiced [against Jews]” could be heard “on the lips of men all over the city.” That doesn’t fit with the idea that Atlantans were strongly anti-Semitic. And they weren’t: Numerous Jews have said that the South then, as now, was the most pro-Jewish area in the country.
The book goes on to say that “many on the street sympathized with Mrs. Frank’s letter denouncing Dorsey,” which reinforces the previous point.
Even though the crowds surrounding and eager to get into the courtroom are described in the book — and remember, The Frank Case was published in the city where the trial took place, just weeks after it ended — nowhere are the supposed “anti-Jewish mobs” surrounding the courthouse, screaming “hang the Jew or we’ll hang you” mentioned. They were not mentioned because they did not exist. The “screaming mobs” are the product of the well-oiled and heavily-funded pro-Frank propaganda machine. That propaganda machine was begun in 1913 by cynical advertising mogul Albert Lasker (who was paid hundreds of thousands for supporting Frank even though in private he suspected Frank was a sexual pervert) and continues today under the aegis of the “mainstream” media and pressure groups like the ADL. (The ADL was founded by the B’nai B’rith, of which Leo Frank was an official at the time of his crime and conviction.)

We at the Mercury are offering this audio book in three parts in April of the year 2020, in commemoration of the life of young Mary Phagan, who died at the hands of Leo Frank on 26 April, 1913 — 107 years ago this month.

THE AMERICAN MERCURY is proud to present the first part of our audio version of a rare, almost-suppressed book on the murder of Mary Phagan and the trial of Leo Frank, 1913’s The Frank Case — published almost immediately after the events it details took place, when they were fresh in the minds of Atlantans. Only one original copy is known to survive, though there are rumors of others. This book is also unique as it is the earliest known book published about the case.

Its full title is The Frank Case: Inside Story of Georgia’s Greatest Murder Mystery. It was published anonymously. It highlights the events leading up to the trial and aftermath surrounding the April 26th, 1913, murder of Mary Phagan by her sweatshop boss, the superintendent of the National Pencil Company, Leo M. Frank. The book strives to maintain neutrality and includes a dramatically-rendered history of this sensational crime.

Published by The Atlanta Publishing Company, Atlanta, Georgia, in September 1913, the one known surviving copy is very fragile, printed on acidic paper, and in rapidly-deteriorating condition. This rare and possibly unique volume was scanned by Georgia State University and made available to the general public. We are now proud to present The Frank Case as an audio book.

The book’s Preface reads:

The sensational case of Leo M. Frank is undisputedly Atlanta’s and the south’s greatest murder mystery of modern years.

The story of how little Mary Phagan was foully murdered as she went to get her pay at the National Pencil factory, revolting and horrible as it is in its details, naturally interests every working man and every working woman.

The mystery of the crime compels the interest of everyone who hears about it.

“The Mary Phagan murder mystery,” however, lost its identity when Leo M. Frank, superintendent of the big factory where the humble little employe met her death, was arrested and it became the Frank case.

In no other murder case in the south has there been such intense interest. It has become more than the ordinary murder mystery; more than the story of a man of position charged with slaying in lustful passion a little factory girl. The reason of the unusual importance of the case is, it is charged, that Frank is being persecuted because he is a Jew.

The story of the fearful crime; of the principal developments of the four months that followed it, and finally the story of the great, trial, where for a solid month the two greatest criminal lawyers in the south battled against the keen wits of Atlanta’s solicitor general to save Frank, has been told by press reports.

Many of the interesting features about the Frank case, however, have never been printed, because the newspapers dared not embody them in their accounts.

This work ends with the conviction of Frank in the superior court of Fulton (Atlanta) county. Trial did not end the case, for immediately after the young defendant was sentenced to pay the death penalty, a motion for a new trial was made, and it will be months, probably years, before he hangs, if he ever does. From the day of his conviction, however, the fight for Frank’s life became a technical legal battle. The real story ends with the trial and every essential feature is given here.

Why was Leo Frank lynched? — and why was he lynched, not by a mob of illiterate haters, but by an assemblage of community leaders and eminent citizens? Does the current media story about Leo Frank — that he was an innocent victim of widespread and “virulent” anti-Semitism — really hold true when we examine the facts?

Newt Lee, the nightwatchman of the National Pencil Company was being framed for the murder of Mary Phagan. We know now without the slightest doubt that Lee was innocent. But the pro-Frank forces, even at this early date in the case, were already engaging in the planting of evidence, impersonation of detectives, and other skulduggery in order to pin the crime on an innocent man — and this would not be the last time they would do this.

Just as there is no doubt today that Newt Lee was innocent, there should just as little doubt today that the principal behind this framing attempt was not innocent. The framing of a man who had nothing to do with the murder is not the act of an innocent man.

THERE HAS NEVER been a better refutation of the 1982 supposed testimony of Alonzo Mann “exonerating” Leo Frank of the charge of murder than in this book by the Historical Research Department of the Nation of Islam. They bring up the points that writers for the Mercury have brought up casting considerable doubt on Mann’s story, but add new information that, to this writer’s knowledge, has never been published before. It is the definitive deconstruction of the Mann fable, which was used in the 1980s as a bludgeon by the ADL — twice — to try and extract a pardon for Frank from the state of Georgia — something that might well be tried again now that a new governor is in place there. WE HEAR A LOT today about people “playing the race card” — using race unjustly in a dispute, or as a moral bludgeon to obscure the facts. In 1913 Atlanta, the Leo Frank defense team played the race card — and in a very big way. Interestingly, the pro-Frank forces used race in a way that most people would find grossly unacceptable today: crudely attacking prosecution witness James Conley, a black man, in open court and on the record as a “dirty,” “lying,” “thieving” “nigger” — and characterizing the sex killing of Mary Phagan as a “Negro crime” of which “white man” Leo Frank, president of the Atlanta B’nai B’rith, would be — they insinuated — “incapable.” (ILLUSTRATION: Leo Frank’s lead attorney, Luther Z. Rosser, who, along with Reuben Arnold and other members of the Frank defense team, played the 1913 version of the “race card” with vigor, attacking James Conley in particular and, in his words, “niggers” in general.)

In this, the seventh audio segment of this ground-breaking work originally published by the Nation of Islam — part of their series called The Secret Relationship Between Blacks and Jews — we also learn that the Frank defense promoted the idea that there was a separate category of testimony — “Negro testimony” — which wise jurors ought to ignore or regard as false. Nevertheless, the race-baiting strategy failed and the all-white jury believed the black man.

We also hear about Leo Frank’s own statement to the court. We can’t really call it testimony, because under Georgia law at the time, the defendant had the right to make an unsworn statement and deny the prosecution the right to cross-examine him on it — which is exactly what Leo Frank did. Frank spoke for hours on end, and almost all of that time was spent telling the jury about the intricacies of managing the accounts of the pencil factory where he was superintendent — presumably to give the impression that he would have been so busy with his books on that fatal day that he simply wouldn’t have had time to commit the murder and move the body to the basement. It was ultimately unconvincing.

WHEN LEO FRANK was first arrested for the murder of Mary Phagan, his and his defense team’s major focus was placing the blame on Newt Lee, the Black night watchman who discovered the murdered girl’s body. They were so eager to avoid any attention being given to another Black man, Jim Conley, the factory sweeper who later was shown to be Frank’s accessory after the fact — that they totally ignored the sighting of Conley by a witness on the day of the murder. This was a most unusual and revealing omission, since the sighting could have been used by the defense early on to place suspicion on Conley, but they deliberately decided not to do that. This lends considerable credence to the prosecution theory, backed up by Conley’s own testimony, that Conley helped Frank move the body. (ILLUSTRATION: Jim Conley, center, being led away in custody)

In this, the fourth audio segment of this excellent book originally published by the Nation of Islam — the best book we have seen on this subject — we also learn how the Frank team, having failed to fix the murder on the watchman, suddenly “discovered” Jim Conley and tried to blame him for the crime.

Leo Frank even attempted to take credit for alerting investigators to the fact that Jim Conley could write (he had been feigning illiteracy to avoid any connection with the “death notes” found by Mary Phagan’s body), though the testimony of all the detectives, even the detectives hired by Frank, was that Frank had nothing to do with that discovery.

The American Mercury presents the 2013 centennial analysis of the Leo Frank case, in both article format and audiobook serial. This is considered the best analysis of the Leo Frank's trial ever produced in the last 100 years. It includes information seldom brought up in other treatments of the Leo Frank case.

The 1913 Mary Phagan murder trial in Atlanta, Georgia, at the Fulton County Superior Court, where Leo Frank was defendant fighting for his life is an epic drama. The trial took place from July 28th, 1913 and concluded the testimony portion on August 21st, 1913, when the four counselors on each side (Rosser, Arnold, Hooper and Dorsey) began their closing arguments. Hugh Dorsey completed his 3-day peroration on August 25th, 1913, at noon. The petit jury brought their verdict down of guilt hours later. The following day, August 26, 1913, the presiding judge Leonard Strickland Roan agreeing with the verdict, sentenced Leo Frank to hang by the neck until dead. He scheduled the execution day for October 10th, 1913, but on August 27, 1913, Leo Frank's attorneys appealed the verdict resulting in a stay of execution. October 31st, 1913, Judge Roan rejected Leo Frank's appeals for a new trial on 107 grounds. The case was sent to the Supreme Court, who rejected Leo Frank's appeals and ruled the evidence of the trial sustained his guilt. Leo Frank's appeals were rejected by all appeals courts thereafter.
