Let's break this down part by part.

The big square counts as 1
Then we have 16 smaller squares that make up the big square.
We add the 2 middle small squares, of which we see 8 even smaller squares.

There's the 4 3x3 squares
Finally let's find all the 2x2 squares.
There's 4 in the corners, 4 along the edges and 1 right in the middle.

Which brings the grand total to 40 squares!
