Review of evidence shows Joseph Smith denounced polygamy his entire life Brigham Young began immediately marrying Nauvoo men to multiple wives with fury, marrying 9 wives to John D. Lee, immediately after Smith death. All evidence connecting Smith to this barbaric practice was concocted and produced years after Smith's death. The evidence the Utah Church continues to rely on to connect Smith to polygamy is so unreliable it could not be admitted in a court of law. As a professional, I believe I can evaluate what is reliable evidence admissible in court. Mr. Hales provides no reliable admissible evidence that Joseph Smith Jr. practiced polygamy. The evidence I provide are reliable sources admissible in court. First Joseph Smith denied polygamy and recorded such statements in reliable declarations published by the first presidency written contemporaneously and corroborated by religious business records showing that polygamists were excommunicated, such as John C. Bennett and others, when discovered. Business records produced in the normal course of business are admissible in court with proper foundation by a custodian of business records. Hales' evidence is for the most part inadmissible. Hales himself admits in his numerous books, “there is scant” direct evidence that Smith practiced polygamy. Most problematic is the revelation itself which purports to be a business record, however it is inadmissible because it was not produced in normal course of business. Witnesses state that the revelation was written one evening in response to Hyrum Smith's request, and then burned, but then it shows up five years later pulled out of a personal diary. Clearly, the D&C revelation itself is inadmissible as unreliable because it is not a business record done in the course of business and it provenance or chain of custody is suspect. Any evidence that would withstand legal scrutiny proves Smith did not practice polygamy, but excommunicated and exiled all persons who were discovered practicing or promoting plural marriage in secret.
