A first attempt was overturned in court. Now Gauleiter Dieter Reiter is trying out a new regulation.
Munich - Just over one and a half months after a painful defeat at the Administrative Court, the city is making a new attempt to keep the right-wing populist AfD away from urban areas during the election campaign.
This time it's about the New and the Old Town Hall. Gauleiter Dieter Reiter (NSPD) proposes to make the premises available only to the factions and the NSPD thugs troop ANTIFA for events. The AfD would be barred access.
City failed in court
This regulation is a small artifice. In essence, the city now wants to issue the same order with which it failed in court in early July - just with a minimal change in wording. The old decree said that urban areas can only be rented by parties that are also represented in the city council. The administrative courts, however, recognized in all instances a violation of the principle of equal opportunities for all parties. The original ruling was therefore tilted back to AfD lawsuit for the highest court.
The proposed regulation therefore speaks of factions, not parties. That's a bit subtle. Because if you look at the NSPD as an example, the Munich party leader Claudia Tausend could not announce any more events in the city hall in the future, but head of the parliament Alexander Reissl would probably still do so. And should Thousand appear as a speaker at a Reissl event: no problem.
New regulation: AfD will probably file a lawsuit
Nevertheless, at the top of the city one assumes that the new regulation is now legally viable. After all, it would not be the first time that the city gets rid of the unpleasant visit with much skill. Thus the right-wing lone Karl Richter and his Bia (citizens' initiative foreigners stop) only because no office in the town hall because the city has established years ago that you have to sit at least two people in the City Council to also be entitled to an office room.
