Detaining people ho break the law is not legal in Italy?

In Europe, if a politician elected by the people to return law and order to the country, decided to not let immigrants into the country, the justice department is looking in to wether they can charge said politician for kidnappinmg of said immigrants. Welcome to the world of nonsence. Is the Justice department now going to sue itself for incarcerating criminals? Because entering a country illegal is indeed still a crime in Europe. But we are not to see it like that anymore.
