The ERC is a CARES Act program that pays a refundable tax credit to businesses that remained up (for any amount of time at all during the COVID "pandemic". Even if you received other benefits from ANY other program, you would still be eligible for the ERC. And, if you had to shut down at some point during or after the restrictions ended for COVID, you could still be eligible. These are refundable tax credits paid out directly to your business and you can put these funds (up to $26,000 per employee) to any purpose you choose.
