Because we live in an imperfect world, we must recognize that some people unfortunately have a physical sex that doesn't lend itself to being easily categorized as "male" or "female". But this doesn't mean we have to extend the same leeway to the psychological self-identification we call gender identity. By limiting legal gender identities to "male" and "female", the Cultural Bill of Rights will preserve our nation's -- and our children's -- sanity.

Progressives have long insisted that the moral debt owed to American descendants of slaves ought to be translated into an economic debt of reparations. But would America truly be acting with justice were it to penalize itself for actions that, however immoral, were perfectly legal at the time? The Founding Fathers didn't think so, and the Cultural Bill of Rights would affirm the Founders' opinion by denying the possibility of reparations for slavery (but not for other systemic injustices, like segregation, that have since been ruled unconstitutional).

The Framers of the Constitution clearly believed that sufficient age and years of citizenship were minimum prerequisites to hold federal office. But the Constitution is strangely silent on establishing similar prerequisites for voters. Perhaps the Framers thought those criteria went without saying, believing the states would never forsake such obvious wisdom -- if so, they thought wrongly, and it's up to the Cultural Bill of Rights to speak the wisdom they left unspoken.

For 150 years the Supreme Court has consisted of nine Justices, but this number isn't hard-set by the Constitution. Progressives have historically sought to increase the number of Justices on the Court to improve the odds of the Court's rubber-stamping a progressive agenda. The Cultural Bill of Rights will thwart these progressive aims by setting the current number of Justices in stone.

Senators were originally chosen by state legislatures until gridlock in those legislatures resulted in Senate seats remaining vacant for far too long. But the solution Congress and the States implemented was worse than the problem: The 17th Amendment greatly distorted the function of the Senate as a bureaucratic reality check on popular aspirations. The Cultural Bill of Rights restores the balance by repealing the 17th Amendment and solving the original problem of gridlock in a minimalist fashion that preserves our federal system.

The Fifth Amendment of the Constitution implicitly states that the government can take private property for public use. But what constitutes "public use"? The Supreme Court, lacking a clear Constitutional definition, has made some questionable judgments concerning what "public use" means. Progressives have long sought to use the Supreme Court to undermine the people's will in prescribing capital punishment for certain heinous offenses. Scott Adams describes in his book "Loserthink" how some people's limited experience with various fields of knowledge can trap them in bubbles that keep them from interpreting reality correctly. But Scott, it turns out, is not immune from being bubbled himself.
