I am writing today regarding a matter of Trademark registration and Amazon Brand Registry 2.0 for my Amazon store.
I believe you and your team could help me find suitable solutions for the future of my business.
If I may, I’d like to explain our situation:
We’ve been selling silicone wedding rings on Amazon USA, UK and Australia for the past few years.
We own 1 Parent ASIN and 40 Child ASINs (5 colors, 8 sizes), and are the only sellers of these ASINs on Amazon.
Our brand name is “Redacted”.
We did register in the Amazon Brand Registry 1.0 on Amazon.com, back in September 2016.
At the time, a Trademark was not needed to get registered.
As of today, we are experiencing issues regarding the control of our brand on Amazon UK.
For example, we cannot sell some of our Child ASINs on Amazon UK, because their listings have an Intellectual Property Infrigement “flag”.
Therefore, I would like to authorize my brand to be sold in the UK, but I am unable to log into the Amazon Brand Registry since I am registered in the “old version”…
A valid Trademark now seems to be needed to get registered with the latest version of Amazon Brand Registry.
For that reason, we commissioned a study and worked closely with (Redacted) regarding a potential trademark application, both in the UK and in the US. We tried with brand name, logo, and both.
Unfortunately, they found that the owner of the similar trademark “Redacted” (in the same Section 14) is a rather big and well-known company. Therefore, the probability of our brand (Redacted) getting trademarked is negative.
The only solution for us seems to be a change of brand name (partial or complete), but we are seriously concerned by the impact it may have on our Amazon business.
Now, I’ve heard of your expertise and I’d like to ask you a few questions, so that you can direct me to your services:
- Do you necessarily have to own a Trademark to switch to Amazon Brand Registry 2.0 when you are already in Amazon Brand Registry 1.0?
- Is there a way to allow my brand to be sold in the UK without going through the Amazon Brand Registry 2.0 and remaining in the Amazon Brand registry 1.0?
- If we change our brand name on Amazon (from “Redacted” to “Redacted Brand Name”, can we predict the impact on our sales and number of reviews?
